Haiti - Electoral Law : Novelty, clarification and already a request for amendment...
The new electoral law published December 10, 2013 in the #229 of the official newspaper "Le Moniteur" brings several clarification and novelty.

Thus, it will no longer possible to a candidate who is not in good standing with the DGI, to make a late payment and cumulative of its unpaid charges... Article 90 paragraph m) states "The five (5) recent proof of payment of tax charges ; each attestation, to be admissible, must establish that the tax has been paid during the fiscal year concerned ;"

The Center of tabulation under section 171 now equipped of 10 annexes, one for each department. It is created a specialized unit called : 'Tabulation Center with an annex in each BED [...]' whose role is defined in section 171.1 which states "The Tabulation Center works independently under the supervision of the Permanent Electoral Council. The Annexes in the BED conduct the entry and processing of the minutes of the counting and establish following these operations the preliminary election results they transmit at the Tabulation Center with the original minutes. The Coordinator of the Tabulation Center compiles the departmental preliminary results, transmits them through the Executive Director to the CEP to be published and posted in the BED and BEC after verification by the members of the Council."

The issue of residence, subject of controversy and strong challenge is now clarified in Article 235 of the Electoral Law "For the purposes of this Act, the place of residence is defined as the main place of dwelling or residence, in general, the place where a person usually and actually resides with his family."

Surprise! In this new law, parliamentarians have eliminated the electronic vote that they yet demanded strongly to reduce the massive fraud favored by human intervention in the electoral process, justifying today this elimination by their fear of "shenanigans of government" [!]

In addition, Monday the deputy Danton Léger tabled in Parliament an amendment to Article 57-1 of the Electoral Law, which states that "Article 57.1. The agents who have been appointed on an interim basis in elected office can not participate in the upcoming elections." The Deputy wishes in order to according to him "to comply with constitutional requirements, to harmonize social relations, to safeguard a climate of peace and political stability," that it is necessary to repeal section 57.1 by replacing this article with the following wording : "
"The agents who have been appointed on an interim basis in elected office can not participate in the next election if they do not resign within 8 days of the publication of this repeal." Recall that this amendment must be approved by the two chambers.

We propose you to be aware of this new law, which will prevent you from being misled by the numerous statements of our parliamentarians, specialists in partisan interpretation...
