Haiti - Politic : The El Rancho agreement, a crisis within the crisis...
To two days of theterms of 10 days specified in the Agreement El Rancho, Parliament seems more devote its efforts to challenge this agreement as to implement its commitments...

Recall that under the terms of the agreement El Rancho signatory parties must take concrete steps to facilitate the progress of the implementation process of the commitments , this within 10 calendar days whose maturity expires April 2, 2014.

Last Wednesday, Cardinal Chibly Langlois, President of the Episcopal Conference of Haiti (CEH), that continues to favor dialogue as a formula to end the crisis, had a meeting behind closed doors in the Senate to try to save the final agreement from the El Rancho political dialogue, which is the subject of numerous challenges (of the opposition), both in the Senate and the Lower House and within political parties, which evoke the "illegal character to the Haitian laws and the Constitution", "the lack of legitimacy of the signatories" or the rejection of Article 12 of the agreement concerning the amendment of the Electoral Act which states : "Article 12: In cases where amendments to the electoral law planned and proposed in the framework of the dialogue are not passed by the two branches of Parliament within the period prescribed in section eight (8) of this Agreement, the Parties note with the Provisional Electoral Council (CEP) the physical impossibility of applying Articles referred.

Consequently, the Parties agree that the said articles are automatically in hold and the electoral body is allowed to override."


In addition 6 senators whose presence is required to achieve a quorum for holding a meeting in the Senate are strongly opposed to this agreement stating that they do not recognize the agreement El Rancho and therefore, they are not required to comply with the terms...

Following this meeting Simon Dieuseul Desras, indicated that this meeting was to facilitate exchanges and find ways to ending the conflict created by the final document, without more details...

Thursday at a press conference, members of the Commission responsible for ensuring the application of the Agreement by the stakeholders (ref. Article 13 of the Agreement), recalled that the Monitoring Committee had no binding power to force actors to respect their commitments and could only hope that the respect of commitments of the parties to the agreement.

Members indicated that they had already organized six sessions and sent correspondence of reminders to stakeholders on each of their respective commitments and the time limit. Only 6 of the 7 members were present : Rudy Hérivaux, Irvelt Chéry, Patrick Joseph, Himmler Rébu, the Representative of the Executive Guy Michel Vincent and Rosny Desroches (Observer). (Representative of Parliament) was absent... Remember that same day, Senator Benoit gave his resignation as First Secretary of the Office of the Senate as a sign of protest, letter that was sent to Parliament Friday, March 28 https://www.haitilibre.com/en/news-10820-haiti-politic-steven-benoit-resigns-from-the-senate-office.html . This resignation perhaps explaining his absence noticed.

It is to be noted that the absence of the representative of Legislative power in the Monitoring Committee, could help fuel the challenge of the opposition in Parliament.

Rudy Hérivaux, one of the members of the Monitoring Committee, said that the Executive had already implemented several points of the agreement, including the publication of certain laws and resolutions of Parliament in the official newspaper "Le Moniteur" https://www.haitilibre.com/en/news-10769-haiti-politic-the-executive-enforces-the-inter-haitian-agreement.html (Ref. Article 2) and that the Executive had also confirmed its three representatives to the Provisional Electoral Council (ref. Article 7 of the Agreement).

In summary, apart from a few points executed in whole or in part by the Executive, there is no evidence so far that any commitment by Parliament included in the agreement, was applied. Only a rumour circulates, following a meeting that would have occurred Thursday, suggesting that Me Néhémie Joseph, one of the representatives to the Transitional Parliament College Permanent Electoral Council, could be replaced in the "new" Provisional Electoral Council...
