Haiti - Justice : End of Mission of the United Nations Independent Expert
Tuesday, Gustavo Gallon, the UN Independent Expert on the situation of human rights in Haiti, ended its mission in Haiti began on July 15. During his stay, Mr. Gallón met with state authorities, the Office of the Ombudsman, members of the diplomatic corps, civil society and the UN system, journalists and members of different political parties. He also participated in a seminar on economic, social and cultural rights organized by the Delegate Minister of Human Rights and the fight against extreme poverty with the participation of the Interdepartmental Committee of human rights. Moreover he went in the department of South and also visited the IDP camp Carradeux (Port-au-Prince).

This mission allowed him to monitor the progress made on the five priority areas identified in its report to the Council of Human Rights in 2014 according to him :

The first of these axis refers to the social, economic and cultural rights, whose the realization "is very precarious in the country, due to the acute level of social inequality that characterizes the Haitian society. To substantially transform this inequality, a key factor, among others, is the assurance of the right to quality education for all and the eradication of illiteracy in a reasonably short time."

A second aspect that needs a shock treatment, "it is the abolition of the practice of pretrial detention and prison conditions" stressed the Independent Expert "It is urgent to take measures at national level [...] These detention centers are now crowded to the extreme and constitute inhuman treatment, cruel and degrading."

A third aspect for which Mr. Gallón asked a shock treatment is that of the confusion around the rules relating to elections. "[...] The uncertainty of electoral rules is a problem that affects the heart of institutional life in Haiti, it deserves to be urgently addressed. In the report I presented to the Council of Human Rights in March, I pointed out that - Parliamentary and municipal elections should have been held in 2012, but in December 2013, there was no certainty as to the dates of the elections - [...] In my present visit, I found that the Government has set the date of October 26 for the first round and 28 December for the second round of parliamentary and local elections. This is a step forward. But there are some events that contribute to wonder whether the elections will actually take place on these dates. These factors include, among others, the approval of the electoral law by Parliament before the end of the current legislature the second Monday in September; the acceptance of the Provisional Electoral Council, which is contested by six opposition parties, or the logistical preparations for the elections for which it is necessary to rely on a period of 120 days from the adoption of the electoral law. Political confrontation has always been a very sensitive subject in Haiti and continues to be today, making it all the more urgent the need for a basic agreement on the rules of the electoral game between political forces in competition."

A fourth worrying aspect is that of impunity that is even more pronounced about the serious human rights violations of the past, for which "it is necessary to take urgent measures to ensure the right to truth, justice and reparation for the many victims." In particular, the independent expert refers to the Duvalier case, for which he requested that the judge responsible for the further investigation, benefits guarantees of independence, the security measures and additional resources to carry out this case.

The fifth aspect emphasized by the independent expert concerning the serious violations of human rights caused by telluric hazards and climatic and statelessness. Mr. Gallon said to note the undeniable progress in the reduction of people living in the camps, while stressing the importance of ensuring durable solutions for IDPs. In terms of statelessness, the Independent Expert said carefully monitor the progress of the dialogue between the Haitian and Dominican authorities. As for cholera, the independent expert noted that the Secretary General of the United Nations visited the country and went on July 14 in the Central Plateau, and launched a sanitation campaign. "I hope that this visit will contribute to implement the recommendation I made in my report of March 2014 on the need to establish a commission of reparation for the victims of cholera, to allow the identification of damages, compensation or corresponding compensation, the identification of those responsible, to stop the epidemic and other measures. As Independent Expert on the situation of human rights in Haiti, I take this opportunity to reiterate this recommendation."
