Haiti - Politic : Senator Moïse, refuses extension of his term !
While since the beginning of dialogue initiated by the President Martelly on September 22, several political actors including the Organization of People in Struggle (OPL), the "Konvansyon Inite Demokratik" (KID) and Civil Society propose to the Head of State to extend the tenure of senators and deputies, until the appointment of newly elected, to avoid an institutional vacuum Thursday at a press conference in Parliament, Senator Jean Charles Moïse, said he was against the idea of extending the terms of Senators and Deputies f the 49th Legislature.

He announced that next week he hands over the material and the keys to his office at the Quaestor of the Senate of the Republic "This is a sign to show that our office will expire on the second Monday of January 2015 and that from that date, we will not return to Parliament as a senator." Recalling that the 6-year term of elected senators in 2009, should have been completed in September, but due to a political agreement to regulate the electoral system, this deadline was postponed to January 12, 2015 and as we were part of the Agreement, we will leave the Senate as expected in this agreement in January."

Senator Moïse is convinced that in January, the President can not rule by decree, recalling that Article 285.1 of the Constitution which provides that "The National Council of Government is authorized to issue in the Council of Ministers in accordance with the Constitution, decrees having the force of law until the assumption of office of Deputies and Senators elected under the influence of this Constitution." was repealed. He believes that the Head of State and the Prime Minister will have no other choice than to negotiate with the opposition, to see how they will leave office.

Note that the repeal of section 285.1 does not remove the obligation of the Head of State and other items such as Article 136, which states that "The President of the Republic, Head of State, ensure compliance and enforcement of the Constitution and the stability of the institutions. It ensures the smooth functioning of public authorities as well as continuity of the state." that could be invoked in the event of malfunction of the parliament and allow the head of state, to ensure the proper functioning of government by governing by decree...

For Moïse Jean-Charles, remain in office after January 12, 2015 would be a way to condone the excesses of President Martelly "we do not accept to extend our mandate," however, he recognizes that this is, a personal decision, that he had not yet shared with his colleagues in the G6, hoping that other senators and deputies of the opposition will follow him in his approach...
