Haiti - Elections : Mirlande Manigat and MOPOD want to negotiate everything, including the resignation of Martelly
Wednesday, Jean André Victor, the Coordinator of the "Patriotic Movement of the Democratic Opposition" (MOPOD), which groups the main opposition party, confirmed having received, on September 18 a letter from the Presidency, inviting him Sept. 30 at the National Palace, for the series of consultations initiated by President Martelly https://www.haitilibre.com/en/news-12116-haiti-politic-first-day-of-dialogue-with-president-martelly.html considering that the correspondence was addressed personally to the coordinator and not to the MOPOD, the Executive Board of the Movement says it will not respond to the invitation.

Meanwhile, Jean André Victor says to be ready to meet with President Michel Martelly, but not as part of a consultation "The MOPOD wants to meet with President Martelly just to negotiate with him and all points of the current situation of the country should be discussed, including his resignation."

Also reacting to the possibility that after January 12, the President Martelly before the caducity of Parliament runs the country by decree, Manigat asserts that the President, even after the caducity of the Parliament, can not issue decrees law, what is prohibited by the Constitution.

Of statements to be nuanced, because since the repeal of section 287.1 which stated "The National Council of Government is authorized to issue in the Council of Ministers in accordance with the Constitution, decrees having the force of law until the assumption of office of Deputies and Senators elected under the influence of this Constitution.", the Constitution remains explicitly silent on the ability to rule by decree for a period of transition, in the absence of a parliament, opening the door to many different interpretations... What's not in the Constitution is not necessarily prohibited in certain circumstances.

Especially since there has already been a precedent under the administration Boniface-Latortue, who deprived of Parliament had ruled by decree during the transition period. Unconstitutional decisions for some, justified by the exceptional circumstances for others...
