The CEP is not above the law
Reacting to the declaration of the electoral Adviser Néhémy Joseph https://www.haitilibre.com/en/news-14049-haiti-news-electoral-zapping.html who claimed that the CEP was not bound by any court decision, Me Thierry Mayard Paul, lawyer by profession, whose candidacy for the presidency is challenged for lack of discharge and which benefits of a judgment authorizing him to compete in the next elections without the certificate of discharge (as Laurent Lamothe) states that this statement is false and describes as illegal any contrary attitude of the members of the Provisional Electoral Council (CEP).

Candidate challenged verdict Tuesday ?
According to the Electoral Adviser Néhémy Joseph, the electoral judges would have finished deliberating, ensuring that after having met the judges, they would have given the guarantee that the verdicts would be known during the day of Tuesday, June 2. Meanwhile rumors are rife, some suggesting that 20 of the 23 challenged candidates would have been rejected, mainly for reasons of lack of Discharge Certificate... We must therefore wait for the official decision of the Departmental Electoral Office of Litigation to truly know what it is.

The Discharge Certificate, a political issue
Pierre Espérance, the Executive Director of the National Network for the Defence of Human Rights (RNDDH), believes that the issue of discharge constitutes a political issue that should have been treated as part of the negotiations in December 2014. He recalled that several legislative candidates were excluded by reason of discharge, but argues that it can not give the same treatment to candidates who applied for a discharge and who would have a favorable advice of the Court of Auditors that those who have made no application to the relevant authorities.

For his part, Jeantel Joseph, President of the Consortium of Political Parties, he also abounds in the sense of a political solution, citing the case of Prime Minister Evans Paul came to power after a political consensus that allowed him to bypass the Constitution and refrain from providing a Discharge Certificate; as well as other ministers and high officials of the Government Martelly/Lamothe which were renewed in the new Government Martelly/Paul without producing the certificate...
