Haiti - Elections : Dozens of legislative candidates with questionable morality (list)
The Defense National Network of Human Rights (RNDDH), which ensures the monitoring of the electoral process, took care to analyze the final list of approved candidates for the 2015 legislative elections published by the Provisional Electoral Council (CEP) https://www.haitilibre.com/en/news-13983-haiti-flash-the-cep-accepts-341-new-candidates-list.html and https://www.haitilibre.com/en/news-13875-haiti-flash-final-list-of-approved-candidates.html , RNDDH argues that the names of many individuals in conflict with the law are in the list of candidates for the Legislative approved by the CEP. They are involved in the perpetration of serious crimes. Some were arrested, kept in police stations or sub police stations of the country, to then be irregularly or provisionally released.

RNDDH proposes to share with all those interested in the subject, a disturbing fact specifically on the morality of candidates for legislative and which is likely to worry all Haitian citizens.

Recall that the electoral decree of March 2, 2015 https://www.haitilibre.com/en/news-13316-haiti-elections-prime-minister-paul-handed-the-electoral-decree-to-the-cep.html currently in force, in Article 90 requires that "To be admissible, the declaration of candidacy dossier to all elective offices must also be equipped with the following :

e) A certificate of good conduct and morals issued by Justice of the Peace of the commune in which the candidate resides, to hich is appended a certificate from the Registry of First Instance of his domicile stating that there is, against it, no criminal proceedings leading to an afflictive or infamous;

Moreover, in several courts of first instance visited by RNDDH, it is displayed a set of documents requested by the registries for the claim of a criminal record. Among these parts, is found the police certificate. This is also the case of some of the country's peace courts that require those who want to be issued a certificate of good conduct present :

  • Their birth certificate or extract Archives
  • Their National Identification Card
  • Their proof of residence
  • One (1) police certificate
  • Two (2) identity photos.

This implies that even if the criminal records takes into account only the convictions pronounced, the judicial authorities still wish to have all the criminal file of the citizen before saying if he is of good moral character. This is also in the sense that the Electoral law of 25 July 2008, Article 94, paragraph f) demanded "a certificate of good conduct issued by the Judge of Peace of the commune in which the candidate resides which it will be attached to the following documents :

  • a document, for information, issued by the National Police of Haiti stating that there is against him, no research advice of law enforcement ;
  • a certificate of the Registry of the Court of First Instance of the place of his domicile stating that there is no criminal proceedings against him which led to an afflictive or infamous."

The concern of the legislator who had decided to include this provision, then referred directly to the failure of the Haitian judiciary. It was the manifestation of the legislator desire to avoid so that different positions, will fill with bandits. Indeed, everyone knows that the Haitian criminal chain is weak and is characterized by cronyism. Thus, a person against whom a criminal prosecution is opened can never be the subject of a judgment, that, according to his friends in high places, or even according to its own position in the State.

To corroborate this, RNDDH cites the case of several people who are wanted by the police or are decried by public outcry but which, because of their political or other acquaintance, receive protection against any form of arrest or detention and are never bothered.

Irregularities mentioned in the list of candidates for the Legislative :
Among these candidates, RNDDH observed the case of four candidates for the Senate of the Republic and thirty and 31 other candidates for the Deputation The crimes alleged against them are :

  • 6 murder cases
  • 6 cases of fraud, breach of trust
  • 5 cases of violence, aggression and assault
  • 4 cases of abduction
  • 4 cases of theft
  • 4 cases of forgery, use of forgery and criminal conspiracy
  • 2 cases of illicit drug trafficking
  • 1 case of illegal possession of firearms
  • 1 case of corruption
  • 1 case of rape
  • 1 case of theft of property

Moreover, at least 2 candidates were deported from the United States because of their involvement in reprehensible acts.

Comments and Recommendations :
The case taken as an example by RNDDH are not exhaustive. However, they are very worrying because, RNDDH believes that this is not only a moral issue but also a public safety issue. Indeed, individuals in confit with the law, wanted by the Police and Justice, against whom negative certificates were issued by the Police can they really be part of the Grand Corps, when we remember the dysfunction level of the Haitian judiciary ?

All these individuals cited by RNDDH within this list, must be able to provide the Haitian society, proof that they were not actually involved in the perpetration of improper acts charged against them. Citizens must have all the information concerning the morality of candidates. This is what will allow them to make their choice knowingly.

Additionally, RNDDH believes that candidates who were actually involved in reprehensible acts, should also provide explanations on how they could get their certificate of good morals because, the police certificate must be presented to the court of peace, to obtain this essential document. Yet it would seem that candidates were able to get their certificate of good morals and without having to claim their police certificate.
