Haiti - Justice : Horror of the detention in Petit-Goâve
Tuesday, after his 4th mission to Haiti, Gustavo Gallon, UN Independent Expert on the situation of human rights in Haiti, appointed by the Board of the United Nations Human Rights made a synthesis of his impressions during his mission.

On prolonged pretrial detention, Gustavo Gallon admits that "the Government has made important efforts, especially with the campaign - Punch - and other more structural measures oriented towards training and improved accountability of judges.

The effects, however, are not as remarkable one would like. In fact, the incarcerated population has increased since March. While it was composed of about 10,500 people, it arrived, according to the National Police, to 11.319 prisoners [on a capacity of 4,000 places], whose 8,140 (72%) in custody (and among them 379 women, 203 boys and 20 girls). These are the figures of last week.

I visited the detention center of Petit-Goâve. This is not a prison, but a police station. There are two principal cells of a size of approximately 30 m2 each. In both cells there are a total of 172 detainees, or approximately 86 in each (34 cm2 per inmate]. They can not sleep lying down. There are some who sleep hanging on the roof, in makeshift hammocks . There is a toilet in each cell, source of worms and cockroaches, which attack the skin of prisoners. They are not allowed to take the sun, because the guards feel they are not in capacity to watch them. There is no doubt that they live in inhuman conditions. I urge the Haitian authorities in this regard, to ratify the Convention against torture and its protocol [...]"


Furthermore the United Nations independent expert returned on the impunity concerning violations of the regimes of Duvalier and Aristide that continues, explaining "There is no significant progress in the trial initiated against Jean-Claude Duvalier, which must continue against his consorts after his death. I reiterate my recommendation to create a Commission for Truth, Justice and Peace to clarify and remedy violations of the past, as well as those committed under the governments of François and Jean-Claude Duvalier that under the military regime or that of Aristide. We need clear signals to end the climate of impunity which undermines efforts to establish the rule of law in Haiti. In this regard, I invite the Haitian authorities to ratify the International Convention against enforced disappearances [...]"
