Haiti - Politic : Do not confuse Inauguration and Installation
While the opposition continues to criticize in the media the installation of the Prime Minister a.i. named, Fritz Alphonse Jean outside the agreement of 5 February and the Constitution, the latter believe it necessary to explain that it was not installed, but sworn in, a significant difference.

He first recalls that the step of the prior ratification of the choice of prime minister by Parliament before his nomination and his inauguration was canceled as it was laid down in Article 137 before the amendment of the Constitution. The Prime Minister and members of his cabinet are therefore in function before their presentation to Parliament; Article 158 of the Constitution stipulates that "The Prime Minister in agreement with the President chooses the members of his Cabinet of Ministers and appears before Parliament to obtain a vote of confidence on his declaration of general policy..."

Before explaining a certain number of points "The Prime Minister can not make those choices without being invested in this quality. This is also a constant since the adoption of the Constitution in 1987. Every Prime Minister were invested in their positions prior to the presentation to Parliament for the policy statement. Before the 2011 amendment, some Prime Minister have even been installed in office at the Primature before this exercise.

The elimination of the step of ratification took place in 2011, allows the Prime Minister and ministers begin to exercise their functions before presenting the general policy. However, in the current situation, the agreement of February 5, 2016 for institutional continuity provides that Parliament must confirm the eligibility of Prime Minister of consensus designated and invite him,
accompanied by members of his government to appear by before both Houses, in plenary session, in order to receive the vote of confidence of his policy statement before being installed in office.

However, it should not be confused inauguration and installation. An inauguration ceremony is a formal ceremony during which an individual assumes the functions or position of authority and power; the installation relating to the action of solemnly placing someone in charge and in the place where it must do so, following the prescribed form."


It is for this reason that the documents of the Prime Minister a.i. were filed Monday afternoon in the office of the Presidency of the Chamber of Deputies (information confirmed by the first Secretary of the Chamber of Deputies Abel Descollines.) A special commission will be formed and will be responsible for the analysis of documents to confirm the eligibility of Prime Minister a.i. and his invitation for the vote of confidence before installation in office. The same process must be repeated in the Senate since it is not a bicameral Commission but individual.
