Haiti - Politic : The PHTK claims the Mayor of Port-au-Prince
In correspondence dated 22 July 2016 addressed to Léopold Berlanger, President of the Provisional Electoral Council (CEP), Marie Yanick Mézile, Vice President of the Haitian Tèt Kale Party (PHTK), seeking his intervention to repair the harm and damages caused to the party following the decision taken by the National Electoral Office of Litigation (BCEN) to disqualify the cartel winner of PHTK to the benefit of cartel loser of the Alternative League for Progress of Haiti (LAPEH).

"Referring to correspondence dated 31 May, 16 June 20, June 21, 2016 [...] the Haitian Tèt Kale Party (PHTK) requests your intervention to repair the damage and harm caused to the latter, following the decision taken by the National Electoral Office of Litigation (BCEN) chaired by Adviser Marie France Joachim, to disqualify the cartel winner of PHTK in the commune of Port-au-Prince to the benefit of cartel losing of LAPEH.

The facts :

- On 7 November 2015 the preliminary results published by the CEP, after counting of 969 minutes out of 1,073, show that the cartel of PHTK (10,308 votes) wins with a difference of 339 votes on that of LAPEH (9,969 votes) and 1,455 votes on that of Fanmi Lavalas (8,853 votes).

- On 26 May 2016 the BCEN chaired by Marie France Joachim order the setting aside of 36 minutes at the request of cartel losing of LAPEH; the sidelining of 36 minutes on request of cartel losing Fanmi Lavalas; a reclassification of candidates based on the recount.

- June 11, 2016, the CEP after new counting n the basis of the minutes sidelined, proclaims the cartel LAPEH winner in the commune of Port-au-Prince with 9,078 votes.

[...] The PHTK made the following observations :

1. New counts at the Tabulation Center was made in the absence of representatives of PHTK cartel.

2. Among the 72 minutes set aside, the MA 20537 and MA 20668 included on both the request of Fanmi Lavalas and that of LAPEH. While MA 20348 is repeated twice on the request of Fanmi Lavalas.

3. Taking into account these errors, the number of minutes sidelined is actually 69, not 72.

4. The minutes MA 20521 and MA 20536 declared 'healthy' by Judge Pierre Domingo, during a check at the Tabulation Center May 23, 2016, appear on the list of sidelined requested by LAPEH.

5. The cartel of LAPEH was declared winner after counting of 889 minutes out of 1.073, that is to say, after setting aside 70 minutes instead of the 69 listed above.

6. The CEP did not reclassify the candidates as required by the decision of the BCEN.

7. No calculation from the minutes sidelined by the BCEN of Ms. Joachim allow to justify the 9.078 votes granted to LAPEH cartel in the final results.

8. All legal actions brought by the PHTK against these gross errors have been deliberately ignored by the CEP [...]

Based on the foregoing, it is clear that the cartel of PHTK was the victim of an arbitrary decision. It appears that the count used as a basis for the disqualification of the candidate of PHTK is wrong. Similarly, and tainted of vice, the number of votes given to LAPEH candidate in the final results. Consequently, the decision to declare winner the candidate of LAPEH is arbitrary, unjust and illegal. This is why the PHTK asks you to form a commission of inquiry to shed light on these wrongdoings acts detrimental to democracy.

Knowing that the BCEN who ordered the questionable decision was chaired by Adviser Marie France Joachim, renowned activist, respectable and respected, who has never hidden her hostility towards the PHTK and his presidential candidate, Jovenel Moïse; who has never hidden her aversion against the elections of 9 August and 25 October 2015, it is legitimate to doubt of her impartiality and objectivity in the management of upcoming elections. Based on the statements of Ms. Joachim reported in Le Nouvelliste, December 11, 2015, during the demonstration of 10 December 2015 organized against the 2015 elections by RNDDH, the POHDH and SOFA, it appears that the Adviser has acted within the BCEN in a partisan way. What is contrary to her status as an impartial and independent judge.

[...] The PHTK believes, rightly, that the militant actions of Ms. Joachim against its candidates and elected officials, which today result in the arbitrary disqualification of winner cartel of PHTK, are likely to discredit the electoral process. Because her bias might undermine the foundations of the rule of law and the democratization process in our country [...]"
