Haiti - Justice : The 3rd Power believes that the governance is illegal and illegitimate
The Court of Cassation, in an open letter to the people of Haiti, the international community and the Haitian Parliament, signed by Jules Cantave, its President and 5 other judges : Joseph Mécène Jean-Louis, Windelle Coq Thelot, Kesner Michel Thermesi, Franzi Philémon and Louis Pressoir Jean-Pierre, expresses its deep concern over the dual political and humanitarian disasters now raging in Haiti. It considers that "Governance of the Republic is under the auspices of illegal and illegitimate authorities."

Letter of the Court of Cassation :

"[...] The governance of the Republic is under the auspices of illegal and illegitimate authorities who deliberately put aside the Judicial Power of the now lapsed agreement of February 6, 2016. They have clearly shown their inability to organize credible and democratic elections to the satisfaction of honest Haitians.

The Court is dismayed by the announcement of the Provisional Electoral Council, which fixed to 20 November the holding of elections that Matthew hurricane had prevented. The Court strongly condemns the odious project of the Provisional Government and the CEP, to undermine the young Haitian democracy by claiming to continue the electoral process in the current conditions in Haiti. Indeed, after the passage of Hurricane Matthew, the Departments of Grand'Anse, South, Nippes and Southeast have been hard hit: schools that were to serve as polling stations were damaged, others serve as temporary shelters for the affected population, the majority of voters established in those regions have lost their electoral card. These citizens are deprived of food, clean water, clothing and are exposed to all kinds of infectious diseases, including cholera. The country thus risk plunging into an even darker chaos.

In addition, justifying the damage caused by the hurricane Matthew, the Provisional President Jocelerme Privert has not bothered to foster the defilement of the national soil by Dominican armed forces [note HL: American military, French, Dutch and other countries related to humanitarian assistance, are also present in Haiti] under the cover of the assistance provided to victims of the Hurricane Matthew. Such offenses committed by a Haitian Head of State, the Prime Minister, his ministers and state secretaries are liable to penalties duly pronounced by the High Court of Justice, in accordance with Articles 93, 97, 140, 159, 163, 185 and following of the Constitution of 1987. Citizen awareness of Judges of the Court of Cassation in particular and of Haitians in general is revolted by the inconsistencies of the Provisional President. We requiere the authorities concerned, primarily, the Presidents of the Senate and the Chamber of Deputies to take their responsibility face these unacceptable abuses of Heads of the Haitian Executive.

We declare solemnly that it is time to put the country on the democratic rails, to bend to the injunctions of Article 149 of the Constitution of 1987. We call on all forces of Haitian society to come together and unite in order to demand the return to constitutional legality before to be able to carry out elections to the dimension of our aspirations."
