Haiti - PetroCaribe : What says the resolution passed by the Senate (full text)
The controversial resolution of the Senate voted by majority on 1 February 2018, https://www.haitilibre.com/en/news-23446-haiti-flash-senate-transfers-petrocaribe-report-to-csa-ca.html requesting the Superior Court of Audit and Administrative Litigation (CSC / CA) to conduct a Comprehensive Review of the Management of Petro-Caribe Funds for the period from September 2008 to September 2016, was published in the Official Journal "Le Moniteur" No. 29 dated Friday, February 16, 2018.

This resolution whioch one have said anything and everything, without having the definitive text which has just been published, makes it possible to know by reading the "Considering" the reasons on which senators have relied vote for this resolution, we invite you to share the full text.

Text of the Senate Resolution :

"RESOLUTION OF THE SENATE OF THE REPUBLIC REQUESTING THE SUPERIOR COURT OF AUDIT AND ADMINISTRATIVE DISPUTES (CSC / CA) TO CARRY OUT AN EXTENSIVE REVIEW OF THE MANAGEMENT OF THE PETRO-CARIBE FUNDS OVER THE PERIOD FROM SEPTEMBER 2008 TO SEPTEMBER 2016.

Considering the 1987 Constitution as amended, particularly Articles 118, 125,200,200-1,200-2,200-3,207 and 233;

Considering the Decree of 23 November 2005, amending that of 4 November 1983 reorganizing the Superior Court of Accounts and Administrative Disputes (CSC / CA);

Considering the Rules 217, 218, 219, 220 and 221 of the Rules of Procedure of the Senate of the Republic;

Considering the introduction in the Senate, dated 23 August 2016, of the report of the Standing Committee Ethics and Anti-Corruption of the Senate of the Republic on the management of PetroCaribe funds;

Considering the tabling, on November 14, 2017, of the report of the Special Senate Committee to deepen the inquiry into the management of PetroCaribe funds, which has be discussed on Wednesday, January 31, 2018;

Considering that the Assembly of Senators, not satisfied with the report of the Standing Committee on Ethics and Anti-Corruption of August 3, 2016, has formed a Special Commission to further investigate the use and management of PetroCaribe funds;

Considering that the report of this Special Commission suffers from shortcomings attributable to political inclinations of the Commissioners, which taint it with partisan considerations;

Considering that, far from shedding light on the subject, this report reinforces the confusion, multiplies the questions on the management of these funds;

Considering that the Superior Court of Accounts and Administrative Disputes is the judicial organ responsible for judging the acts of the Public Administration, the accounts of the authorizing officers and accountants of public funds, in accordance with the Constitution in its article 200 and the Decree of 23 November 2005;

Considering the need to respect the principle of the separation of powers and the field of competence of republican institutions;

Considering the need to fight objectively against corruption;

The Senators Assembly proposed and passed the following resolution:

Article 1: The Assembly of Senators asks the Superior Court of Accounts and Administrative Litigation (CSC / CA) to carry out a thorough analysis, verification and examination of the management of Petro-Caribe funds over the period from September 2008 to September 2016, in accordance with Article 200 of the Constitution and the Decree of 23 November 2005 amending that of 4 November 1983.

Article 2.- This resolution will be transmitted to the competent authorities.

Article 3.- This resolution will be submitted to the Executive for promulgation and publication in the Official Journal of the Republic "Le Moniteur".

Article 4.- An amplification of the present resolution will be transmitted to the Superior Court of Accounts and Administrative Litigation (CSC / CA) for the follow-up.
