Haiti - Politic : The Government explains about the decree concerning the decisions of the PNH
Following the reactions caused by the publication on Monday in the Special Monitor N ° 6 of a presidential decree submitting to the approval of the National Police Superior Council (CSPN), the decisions of the National Police of Haiti (PNH) https://www.haitilibre.com/en/news-24529-haiti-politic-the-state-takes-control-of-the-pnh-strong-reactions.html , Wednesday at a press conference Jean Roudy Aly, the Minister of Justice gave an update on this decree, which according to him, aims only to better coordinate actions within the Government and said that the Chief of Police is and remains the decision-making authority within the Police Institution.

Minister Aly thought it necessary to establish the difference between "approval" and "authorization" while stating that in the context of this file, it will simply be a simple approval from the CSPN without extending on what happens if the CSPN does not approve a decision of the PNH.

For his part, Joseph Guyler C. Delva, the Minister of Communication also intervened Wednesday in a separate press conference recalling Article 1 of the decree which states "Decisions concerning appointments or transfers at the level of the central and departmental directorates of the National Police of Haiti as well as those concerning the general regulations, the training and the reinforcement of the staff, the discipline, the career, the remuneration of the members of the PNH are subject to the approval of the Superior Council of the National Police (CSPN) before their implementation" rejecting all allegations that the Government would like to politicize or control the PNH.

Pointing out "This presidential decree was taken with a view to preventing instability within the police institution and at the level of society," adding that "the Government must have the right to review security decisions of the Republic."

Delva is less clear in his explanations, leaving the door open to various interpretations, when he recalls "the CSPN is provided by the law on the organization and functioning of the PNH. The CSPN is the highest decision-making body of the PNH which gives directives and instructions to which the Police must submit," recalling that "the Director General of the PNH participates and gives his consent during the decision-making but that it does not he would be impossible to override the provisions adopted by the CSPN, the only body authorized to define the national policy and strategies with regard to the tasks of the National Police."
