Haiti - Elections : Observation Report of CNO on the Tabulation Center
In the Preliminary Election Observation Report of Conseil National d’Observation des Élections (CNO), we can read concerning the Tabulation Center :

"Because of the serious irregularities that occurred during the recent elections to the Tabulation Center, the Coalition of Observation Organizations has granted this time, more attention to the operations that occur at this level. The observations made ​​at the center have revealed that the Manuel de Normes, de Règles et de Procédures repeatedly claimed by the observers is finally written and published in part on the Website of the CEP, which is a good thing.

As recommended by the expert mission of the OAS, specific criteria were established for the acceptance or putting away of a minute. Regulations have also been established regarding the presence, access rights and limitations of the Observer to the Tabulation Center.

A significant number of minutes, nearly half, 15.000 were submitted for consideration to the Legal Control Unit. Which indicates the low performance of polling stations and the need to raise the skill level and preparedness of members of these offices.

Some members of the Legal control units also need a recycling to provide faster and more efficient work.

The officials of the Tabulation Center have not followed the instructions of the Manual of Procedures, which provides an information session and of question-answer each day at noon. It happens sometimes five days without that this session takes place. Now there is a critical need for information in the population. The lack of information encourages speculation, propaganda, disinformation. This briefing should include not only the number of minutes arriver and treated, but also the number, the identity of the minutes shelved, nd the reasons which motivated this shelving for each group of minutes.

In addition the minutes shelved should be immediately available on the website of CEP in order to allow candidates and parties to realize if the reasons given for the shelving are justified and thus prepare for possible challenges that must be done within 72 hours after publication.

The provision 6.6.3.6 a) of Manuel de Normes et de Procédures which states : "Before their publication by the CEP, the preliminary results of elections are a state secret" is contrary to the principle of transparency that must govern democratic elections, and also in contradiction with Article 147.1. second paragraph of the electoral law which states "If necessary, after the data processing, and before the proclamation of results, political parties and independent candidates participating to the elections have access to the to the Tabulation Centre for verification." The invocation of state secret here, does not have its "reason for existence" In this case it's more the transparency that must prevail.

We strongly recommend to the CEP to review this provision and to be directed rather in the direction of the integral transparency and to publish the results progressively in relation to their recording in the Tabulation Center. This will strengthen confidence in the process and reduce the risk of violence and psychological manipulation and other.

Quantitative analysis of data received :
The voter turnout is around 30%. For the legislative elections, data express that no political party will have an absolute majority in both the two (2) rooms.

The CNO has conducted a quantitative analysis of data received from its observers and those of the coalition in the various voting centers across the country. In this sense, the CNO and the coalition expressed their reservations in relation to the embargo placed by the CEP on any information regarding the voting trends and which is contrary to the letter and the spirit of the electoral law and democratic practices. However, in a spirit of discipline, it refrains to reveal the information collected. It reserves the right to do so timely."
