Haiti - Elections : Conclusions of observations of May 29
Although the preliminary results of the second round of parliamentary byelections held Sunday, May 29, 2011, on the Constituencies of Fond-Verrettes/Ganthier, la Vallée de Jacmel and Verrettes have been published yesterday by the Provisional Electoral Council (CEP) https://www.haitilibre.com/en/news-3077-haiti-elections-preliminary-results-of-sunday-s-byelections.html , Today we publish the results of observations made ​​by the National Network for the Defence of Human Rights (RNDDH) and two of its departmental structures, located in the departments of South-east and Artibonite.

1. Positive aspects
On the security plan, the officers of the Police Nationale d'Haiti (PNH) and UN Mission for Stabilization in Haiti (MINUSTAH) have been deployed in the constituencies mentioned above. In some voting centers situated in areas deemed to be hot, agents of specialized units of the PNH were put in faction. The police have been seen on the court as well as around of the voting centers. They have not hesitated to intervene when it was necessary. For example:

  • At the Voting Center Ecole Nationale de Moreau Douet, constituency of Verrettes, the PNH has arrested Demesmé DORSONNE, close to the parliamentary candidate under the banner of the political party AYITI AN AKSYON, Jean Beauvoir DORSONNE, with, in his possession, a dozen electoral cards.
  • At the Voting Center Ecole Nationale Morne à Brûler, third section of La Vallee de Jacmel, the PNH placed under arrest Eddy ELTIME and Félix AMBROISE, aka Ti Pri, to have sowed a beginning of mess in this centre intimidated voters and administered blows to an electoral observers responding to the name Village DESROSIERS.

Administratively

  • The electoral staff was present at the scheduled time at different voting centers and the polling stations and it was reinforced by the CEP. Indeed, several responsible of formation of members of polling stations and supervisors, have came as reinforcements to voting centres supervisors and members of polling stations.
  • The electoral guards were noticed in the voting centers.
  • The materials have been delivered on time and, the opening hours of polling stations have been generally respected. Moreover, the electoral partial lists have been displayed in the different voting centers and at the doors of the polling stations.

2. Negative points
No identification of the electoral staff
Supervisors, members of the polling stations, were not wearing shirts and wore no distinctive sign to identify them.

Reception of incomplete kits
The electoral kits, whose the list written in English, were delivered by the MINUSTAH to the officials of some voting centers, open and incomplete. This has been noticed in the the voting centers Ecole Nationale de Payen, Ecole Privée Bon Samaritain, Ecole Nationale Charles Bel-air all located in the constituency of Verrettes neighborhood Liancourt ; Moreover, the quality of materials received by electoral officials has varied from one center to another. Indeed, in some voting centers, members of the polling stations have received candles, others lamps.

Lack of orienteers
Contrary to the elections of March 20, 2011, the CEP did not use the services of the orienteers to assist the potential voters who need help.

No secret ballot
The voters vote has been influenced. Indeed, on election day, several individuals including representatives of political parties, took pleasure to intimidate voters by suggesting them for which candidate to vote.

In addition, several representatives have used inappropriately, the voting procedure established to help those in need, and thereby influenced the voters in the their choice.

Reassignment of polling stations
In previous elections, two (2) voting centers were located in the neighborhood of Fonds Parisien and served the population of the second communal section of Fonds Parisien. For byelections the CEP has decided to to move one of the voting centers to the Ecole Nationale de Thoman. On election day, voters, living to Thoman, went to the voting center newly developed but could not vote because they did not find their names. Only later in the the day of May 29, 2011 they they learned that they had to go to Fonds Parisien, to the voting center Ecole Nationale de Paris of Fonds Parisien to fulfilling their civic duty. It is necessary to emphasize that Fonds Parisien and Thoman are two (2) communities separated by several kilometers of walking. Consequently, many voters had to return home.

Irregularities in voter lists
Several irregularities were found in voter lists. For example:

In several voting centers in La Vallee de Jacmel, the partial list of voters displayed at the doors of the polling stations, contains several names of voters assigned to different polling stations. This was observed in the voting centers of Centre de Formation Haut Tuff, and to the voting center Ecole Nationale de Ternier.

Many voters found their names in the the electoral list displayed, while that they were unable to vote due to the fact that their names were not on the partial list of electors in possession of members of the polling stations.

This same scenario was repeated in the the voting centers Ecole Nationale de Desarmes, Ecole Nationale Charles Bel-air, etc... located in the constituency of Verrettes, Ecole Nationale de la Mardette, located in the first section Galette Chambon, in the constituency of Ganthier/ Fonds Verrettes.

Moreover, in many voting centers, the number of voters displayed is different from the total names in the electoral lists partial held by members of the polling stations. By way of illustration:

  • At voting center Centre de formation Haut Tuff, constituency La Vallee de Jacmel, the electoral list displayed shows a total of one thousand four hundred sixty (1,460) voters for a number of three (3) polling stations. The total of the electoral partial lists held by members of these three (3) polling stations is one thousand eighty three (1,083) voters either a difference of three hundred eighty one (381) voters who will not be able vote at this center.
  • At voting center Ecole Nationale de Ternier, constituency of La Vallee de Jacmel, the displayed list contains three thousand nine hundred and thirty (3930) voters while the total of the electoral partial lists held by members of the polling stations is three thousand nine hundred and nine, (3909) either a difference of twenty-one (21) voters who in fact will not be able to vote.

Other voters who voted in the first round, to the voting center Ecole Nationale de Payen, constituency of Verrettes have not found their names in that center and, consequently, were unable to vote on May 29, 2011.

Irregularities at the level of the ballot
Several ballots have been printed without the space overleaf for the signatures of members of the polling stations. Without these signatures, ballots are considered void. This was noticed at the polling station # 2 of the Ecole Nationale des Sœurs de Saint-Paul, Constituency of La Vallée de Jacmel.

Electoral observation
Observers with shirts bearing the inscription GASETT – Observateur électoral, have been noticed in several voting centers, including the Ecole Nationale Saint Pierre de Ganthier. The observers GASETT have campaigned for parliamentary candidate Pierre Jude DESTINE, under the banner of the platform INITE.

General remarks
The parliamentary byelections, of May 29, 2011 were held in the constituencies La Vallée de Jacmel, Ganthier / Fonds Verrettes and Verrettes, in a serenity near-total, apart from some minor incidents recorded, including to Verrettes and La Vallée de Jacmel, where the PNH had to intervene and arrest (3) individuals whose two (2) in La Vallée de Jacmel and one (1) in Verrettes.

Despite all the allegations of corruption, the CEP has succeeded in achieving the byelections in order to complete the electoral process initiated June 24, 2010.

The irregularities relating to the electoral partial lists are recurrent. Since the first round of the elections conducted by the CEP on November 28, 2010, voters have always faced problems related to non-compliance of the electoral lists, the absence of their names on the electoral lists, etc...

In addition, the names of voters are often displayed in voting centers different from those they are accustomed to vote. This always creates panic and despair among voters who often, prefer to return home.

The counting of the votes on May 29, 2011 was conducted in the dark, regardless of the voting center concerned.

If the turnout of the voters at the polls on May 29, 2011 hovers around 25%, it remains clear that the irregularities recorded, particularly at the level of the electoral lists had an unfortunate consequence of the total participation rate.

With all these considerations, the RNDDH and its two (2) departmental structures recommend :

To the President of the Republic to regularize the situation of the nineteen (19) elected by publishing the results of April 4, 2011 in the the official newspaper of the country.

To the responsibles concerned:

  • Proceed according to the schedule, to the publication of the election results of May 29, 2011, reflecting the reality of the vote;
  • Better coordination the administrative aspects related to the elections;
  • Harmonize once for all, the general electoral roll;
