Haiti - Justice : Two Government Commissioners receive a reprimand from the Ministry of Justice 18/12/2023 09:16:53
In order to better understand what they are accused of, we are publishing the letters from the Ministry which were addressed to them: Letter of blame to Jean Ernest MUSCADIN : "Mr. Jean Ernest MUSCADIN Acting Government Commissioner at the Court of First Instance of Miragoâne.- Object : Reprimands Mr. Government Commissioner ai, The Ministry of Justice and Public Security considers it useful and important to draw your attention to the illegal nature of most of the actions that you take as Acting Government Commissioner at the Court of First Instance of Miragoâne. Far from devoting yourself to your task of working for the benefit of litigants, you have set yourself other tasks and you seem to have established your own rules, your own principles. You even allowed individuals, in your name, and with your blessing to block the public highway on the basis of a rumor, which is absolutely unacceptable for a man of law, let alone a Government Commissioner. The MJSP is very attentive to the complaints and messages it receives about you. While waiting to verify them, he reminds you that your status cannot place you above the laws of the Republic and even less exempt you from accountability. Your most recent blunder of leaving your jurisdiction to go to another claiming that 'yours has no limits' is at most a characterized disregard for the law, at least a worrying blindness and the two hypotheses are extremely serious. The MJSP reminds you that your jurisdiction is that of Miragoâne. For any intervention that would require your contribution to another, you must first be authorized to do so. Your deviations, in general and in particular, are not acceptable. Consider, Mr. Government Commissioner ai, this letter as a final call to order from the Ministry of Justice and Public Security which urges you to get back on the line drawn for all Government Commissioners and make the notions of ethics which must characterize every public service manager. Minister a.i Letter of reprimand to Ronald RICHEMOND : “Mr Ronald RICHEMOND Government Commissioner At the Court of First Instance of Les Cayes.- Object : Reprimands Mr Government Commissioner, The Ministry of Justice and Public Security was able to view a video in which you are filmed, in Port Salut, questioning an individual, owner of a hotel, who is suspected of having harbored bandits and having caused their escape. The MJSP is surprised to see that this interrogation has nothing to do with the one that a Government Commissioner wanting to know the truth could have conducted, as the method is assimilated to that of a reporter wanting to offer an alleged culprit the opportunity to justify himself when you should and could have summoned him to the Prosecutor's Office. Mr Commissioner, the MJSP is appalled by your behavior. Your invectives, in the media, against your colleague from Miragoâne are as much to blame as his maneuvers outside his jurisdiction. A Government Commissioner, at the risk of weakening the State or losing its credibility, does not spread in the media, does not play into the hands of social networks. A dispute between magistrates, regardless of its nature or seriousness, cannot be resolved in public. The MJSJ has no intention of allowing a Government Commissioner to distort the mission entrusted to him and informs you that no additional blunders will be tolerated in the accomplishment of your task.
