Haiti - Case Bélizaire : The Minister of Justice said he's «calm and serene»
Friday, on the eve of his appearance before the Senate, as part of his interpellation in the case Bélizaire, Me Josué Pierre-Louis, the Minister of Justice and Public Safety said he's "calm and serene." Reacting to the allegations of parliamentarians, who consider the arrest of Deputy Bélizaire of illegal and arbitrary, the Minister of Justice stated that "only judges of the courts can rule on this issue and that person can substitute to the justice" mentioning in reference the Article 173-1 of the Constitution which states: challenges whose purpose is the civil rights are exclusively within the jurisdiction of the courts. "In this context, as a judge of my state, I can not judge an illegal and arbitrary arrest. Just as the parliamentarians who defend the constitutional principles that, according to theme, are not respected, all authorities are required to comply with Article 26 and 26.1 of the Constitution which clearly outlines the steps and procedures in the case of an arrest considered arbitrary and illegal."

Regarding the decision of the Government Commissioner, Mr. Félix Léger, to make apprehend the Deputy Bélizaire, the Minister explained "If I felt that the Government Commissioner had made a mistake on the administrative side, I would have revoked him" stressing that no governmental responsibility in the case Bélizaire he added, ""The judiciary is fully independent [...] we did what needed to be done under the procedure laid out according to a consensus between the three powers. If there is problem, it is not at the level of the government, we must look elsewhere."

Declaring that he's ready to accept any decision of the Upper House, the Minister believes, however, "that the procedure of the interpellation has not obeyed to the prescribed of Article 107 and 107-1 of the Constitution. An evil must not be corrected by an evil, by a clear violation of the law mother. The Senate should not interpellate a Minister while the Parliament is in extraordinary session."

Article 26 :Nul ne peut être maintenu en détention s'il n'a comparu dans les quarante-huit (48) heures qui suivent son arrestation, par devant un juge appelé à statuer sur la légalité de l'arrestation et si ce juge n'a confirmé la détention par décision motivée.

Article 26.1 :En cas de contravention, l'inculpé est déféré par devant le juge de paix qui statue définitivement.En cas de délit ou de crime, le prévenu peut, sans permission préalable et sur simple mémoire, se pourvoir devant le doyen du tribunal de première instance du ressort qui, sur les conclusions du Ministère Public, statue à l'extraordinaire, audience tenante, sans remise ni tour de rôle, toutes affaires cessantes sur la légalité de l'arrestation et de la détention.

Article 107 :Dans le cas de convocation à l'extraordinaire du corps législatif, il ne peut décider sur aucun objet étranger au motif de la convocation.

Article 107.1 :Cependant, tout sénateur ou député peut entretenir l'Assemblée à laquelle il appartient de question d'intérêt général.
