Haiti - NOTICE : The Ministry of Economy encourages tax compliance
Monday, during a joint press conference, Wilson Laleau, the Minister of Economy and Finance, Ronald Gray Décembre, Secretary of State for tax reform, Neptune Clark, Director General of the Directorate General of Taxes (DGI), announced that in order to encourage tax compliance (civisme fiscal) the Ministry of Economy and Finance through the Directorate General of Taxes (DGI) has taken several important steps to collect debts of the State and facilitate taxpayers in fulfilling their obligations by providing tax arrangements to regularize the situation of taxpayers in default.

Fiscal debts :
"Any taxpayer who owed to the tax authorities and which will have acquitted, before the end of July 2013, the entire principal amount of of the debt, will automatically benefit from the cancellation of penalties and fines.

If the taxpayer is unable to pay the entire principal amount, it may request before 30 June 2013 the establishment of a settlement plan over a period of 12 months. Penalties and fines will be reduced in this case by 50%. Meanwhile, it will honor monthly its current tax obligations. Any delay of more than 15 days in the payment schedule invalidates the settlement plan.

Taxpayers whose amount of the receivable is not definitely arrested in 31 May 2013, will be able to begin to make payments in order to benefit from these facilities.

No consideration will be given to taxpayers whose entire debt would not be honored during the settlement period. After this period, forced collection procedures will be immediately engaged."


Payment of the 2% withheld :
In addition, the Ministry of Economy and Finance recalls "that pursuant to the provisions of Articles 76 and following of the Decree of 29 September 2005 on the income tax, a deposit of two percent (2%) should be levied on amounts paid within the framework of any contract of service between the State, public corporations, autonomous bodies, state-funded projects, commercial enterprises, industrial or craft, Non-Governmental Organizations (NGOs) in development aid and religious institutions with third parties.

The amount withheld will be paid to the Directorate General of Taxation between the 1st and 15th of each month for the previous month under threat of the application of sanctions and penalties."


Income tax :
Finally, the Ministry of Economy informed the public in general, Directors General and guardians of public enterprises and of public institutions and of public projects in particular "that in accordance with the provisions of Articles 92, 93 and following of the decree of 29 September 2005 on the income tax, a monthly withholding, calculated according to the scale of the income tax of individuals, must be performed on the wages and salaries paid to employees (including professionals related to employees) of these entities.

With respect to persons having their tax domicile outside the country, the withholding will be performed at the rate of 20% of the amount of remuneration. In both cases, the withholding must be paid to the Directorate General of Taxation between the 1st and the 15th of the month following the month of payment.

Absence by these Directors General and guardians, to practice and to pay such tax, they will be personally liable for payment of the tax and penalties and relating."
