Haiti - Elections : Section 241 of the Electoral Act was voted or not ?
While the draft electoral law passed Monday by the Assembly of Deputies, was transmitted Wednesday to the Senate office, and that in France Prime Minister Laurent Lamothe in the media, welcomed the adoption of the draft electoral law; in Haiti, the controversy surrounding the enactment of section 241, setting the end of the term of senators of 2009 to the second Monday of January 2015, is growing...

Recall that already Monday in Assembly, in a note of protest to Jean-Tholbert Alexis, President of the Lower House, Stevenson Jacques Timoléon [Chairman of the majority bloc "Parliamentarians for Stability and Progress" (PSP)] denounced The malicious adoption of that section" adding that "the Assembly was not consulted to decide by its vote" and requested to the President of the Lower House to do not transmit this legislation in the Senate, considering that the Chamber of Deputies was still in debate... The PSP favored rather than the senators in end of term [2014], remain in office until the swearing in of new senators, to avoid a Constitutional vacuum. Proposal deemed inadmissible by Jean Tholbert Alexis, for procedural matters.

The Deputy Me Jean Danton Léger, had then recalled that the report of the Commission was approved by 50 deputies so it will require a petition of more than 50 deputies to reopen the discussion on this article...

At this protest now adds the voice of Ralph Théano, Minister Delegate to the Prime Minister for Relations with Parliament, which wonder "How Parliamentarians voted for and against this article ? How many of them abstained ?" asserting that there was no vote he explains that "The president of the Chamber of Deputies took under his own responsibility to adopt the document." Ready to prove his assertions, the Minister Théano threat "We have the videotape of the session, we will make them available to the entire population on the National TV and other private stations. At no point of time, there has been a vote [...]"

Ralph Théano also indicated that fifty deputies were about to sign a petition, in addition to the protest letter to the executive, recalling that only the electoral law of 2008 is in force. "Only a law flush another law [...] For the time nor the Chamber of Deputies or the Senate have so far voted another electoral law."

For his part, Jean Tholbert Alexis asserts "I decided sovereignly in the light of rules of procedure," indicating that the executive power was going to put pressure on members of the PSP for a resumption of the vote, firmly adding "no vote will be resumed," declaring that he would be ready to reveal to the population the pressures of the executive on the Deputies after the vote...
