Haiti - FLASH : The opposition seized justice to prevent the ratification of the PM
A letter addressed to Gary Bodeau, the President of the Chamber of Deputies bearing the signatures of 8 of the 21 deputies of the radical opposition [Garnier Vikerson (LAVALAS), Joseph Manes Louis (LAVALAS), Spring Belizaire (LAVALAS), Sinal Bertrand (LAVALAS), Jean-Robert Bossé (OPL), Ketel Jean-Philippe (OPL), Reynald Exantus (OPL) and Déus Deronneth (PONT)] informs him of an appeal in cassation suspensive concerning the Order of tax discharge granted to the Prime Minister appointed Fritz William Michel by the Superior Court of Accounts and Administrative Disputes (CSC/CA) and asks him to postpone "all activities related to the presentation of the Prime Minister and his cabinet to the Chamber of Deputies for his Statement of General Policy", scheduled in Assembly on Friday, August 23, 2019

In his offices,

Mr. President,

The deputies signatory of the present, hasten to inform you that there was an appeal in cassation exerted on August 6, 2019 against the judgment of discharge on May 23 in favor of Fritz William Michel. The certificate confirming this appeal is attached to this letter.

The said deputies would like to remind you that this suspensive appeal is the work of a public authority, in its prerogatives of public powers and its mission of public services. They are therefore obliged to refer to Article 11 of the Decree of 23 November 2005 Establishing the Organization and Functioning of the Superior Court of Audit and Administrative Disputes (CSCCA) declaring 'The Judgments of the Superior Court of Accounts and Administrative Disputes are subject to appeal in cassation. An appeal in cassation has no suspensive effect except in cases brought by the public authorities, by virtue of their prerogatives of public authority.' They also remind you also that the appointed Prime Minister did not have a discharge for the period (2009-2011) where he was chief accountant at the Directorate General of the Budget of the Ministry of Economy and Finance; which makes him ineligible to be Prime Minister.

As for the discharge order challenged before the Court of Cassation, the said Deputies ask you, pending a decision of the Court which is the only competent to judge the admissibility of the appeal and decide on the merits, to take all the necessary steps necessary, to suspend all activities relating to the presentation of the Prime Minister and his cabinet to the Chamber of Deputies for his general policy statement.

Hoping that you will urgently grant this salutary step, the said deputies pray, Mr. President, to receive their respectful greetings

Reacting to this letter, Gary Bodeau reminds that the appointed Prime Minister, Fritz William Michel has already received his invitation to come and make the statement of his General Policy statement and that the ratification session was maintained as scheduled for Friday 23 August. Referring to the law and regulations of the House to ignore the justice action that has not yet ruled on the admissibility of the appeal and the request of the opposition deputies to stay the ratification session, he suggests to the deputies who have claims to come to expose them before the Plenary Assembly, which is the supreme decision-making body.
