Lawyers of Sophia Martelly confident of the verdict
Former Senator Louis Gérald Gilles (Fanmi Lavalas) Senate candidate, challenges the candidacy of Sophia Martelly as senator, accusing her of holding dual nationality (American and Haitian). For its part the Platform JUSTIS represented in its complaint by Me Gervais Charles, also challenges the nationality of the candidate and the absence of certificate of discharge. On this last point, JUSTIS alleges in its complaint that Ms. Martelly was the President of the National Commission for fight against hunger and malnutrition, which had at its disposal a budget of over $ 234 million of funds from the PetroCaribe program and that consequently, she should present the certificate of discharge required for accounting of public funds.

Tuesday Me Grégory Mayard Paul, the Special Adviser to the Head of State, with Me Napoleon and Me Patrick Laurent defended their client to the Office of Departmental Electoral Disputes (BCED). Addressing the protester party the lawyers of the First Lady asked, concerning the charge of dual nationality "You have based on what fact to produce this challenge ? You have to establish it... while thos that contests have only as evidence, a sentence taken from an article by AFP published in the edition dated April 23, of Devoir in Montreal where it says "

obviously nothing to worry the defense. Regarding the absence of discharge, the lawyers for the wife of the President, believe that order (24 January 2012) appointing the First Lady at the head of a Commission, does not make her an accounting of public funds and therefore she is not requiered to provide such a certificate. After hearing both parties, the electoral court under Article 111.1 of the Electoral Decree has 24 hours to make its decision "the BCEC or BCED hears the case and makes a decision within a period not exceeding twenty-four hours. It notifies its decision immediately to the Provisional Electoral Council."

The Senate can not decide on requests for discharge
Tuesday Senator Jocelerme Privert stated that with only 10 senators, the Upper House can not pronounce on the requests for discharge of former Ministers "Right now we have 35 processing files to the Court of Auditors, 16 have already reached the limit of prescription, 12 voted for the general body and awaiting vote in the lower house and 16 which have been subject to none vote," stressing that every written request of a former minister concerning his record, a correspondence is addressed to him "but does not have the characteristics of a discharge," citing the case of former Justice Minister Paul Denis, who had written to the great body that has only responded him that the analysis of his case did not reveal any cases of fraud and embezzlement during his time the Ministry of Justice from November 2009 to June 2011.
