Haiti - Justice : The CSPJ call to order the judges of the Court of Cassation
Wednesday, following the open letter of the Court of Cassation who considers that the governance of the Republic is under the auspices of illegal and illegitimate authorities https://www.haitilibre.com/en/news-18977-haiti-justice-the-3rd-power-believes-that-the-governance-is-illegal-and-illegitimate.html and a resolution, also issued requiring the replacement of de facto President Jocelerme Privert https://www.haitilibre.com/en/news-18983-haiti-flash-the-court-of-cassation-request-the-replacement-of-jocelerme-privert.html , the Superior Council of the Judiciary (CSPJ) has called to order the judges of the Court of Cassation for their public position.

Note that the Court of Cassation t is not the only entity to take a public position in this matter, the National Association of Haitian Magistrates (ANAMAH), union body responsible for bringing the claims of judges, acknowledged in a statement of Judge Durin Duret, President of ANAMAH, "the right of the Court of Cassation to demand the replacement of de facto President Jocelerme Privert. Privert leading only by force."

CSPJ letter to the judges of the Court of Cassation :
"[...] Having learned with astonishment, through the press, the press note and the resolution signed by the Honourable Judges of the Court of Cassation of the Republic, the members of the Superior Council of the Judiciary, the signatories of this, believe it is imperative for the respect the principles of ethics and professional conduct, to fix their position.

The signatories of this letter, members of the Superior Council of the Judiciary, administrative body, of control, discipline and deliberation of the Judicial Power, declare that the Judges of the Court of Cassation by publicly taking such a position deviated of the sacrosanct principles of neutrality, of impartiality and independence that characterizes the exercise of the function of magistrate.

Consequently, the signatories of this position of the Superior Council of the Judiciary are entitled to recall and, in fact, they remind the Judges of the Court of Cassation to recover and avoid ending up in such a situation prejudicial to the smooth functioning of the judiciary in its entirety.

Signatures :

President of the Bar Liez Édouard representative of the Federation of Bar Associations of Haiti (FBH)
Dilia Lemaire representative of civil society
Jean Etienne Mercier Representative of Justices of the Peace
René Sylvestre Government Commissioner at the Court of Cassation"
