"Considering that the Constitution of 29 March 1987 Article 59 states that national sovereignty is exercised by three (3) branches: Legislative, Executive, Judicial. That,

moreover all these three branches constitute the essential foundation of the organization of the State, which is civil;

Considering that in the lapsed agreement of 6 February 2016. The Court of Cassation was excluded by the other two branches of the State. That, for evidence, the Head of State in a recent public statement, emphatically asserted that the decision to make enter the Dominican troops on national soil was taken together with the Presidents of the two branches of Parliament regardless of the Judicial Power;

Considering that the Parliament first and foremost vigorously denounced this fact that has shocked the national conscience;

Considering that some organizations, political parties, political groups and personalities had patriotically hailed the magistrates of the judiciary in a note and asked them to intervene to save the Nation that is at risk;

Considering that, in the when the force of the law can not impose the country is then delivered to the law of force which is unacceptable;

Considering it is imperative for the Court of Cassation, the Guardian of the law, to ensure scrupulous respect for the constitutional order and the proper application of the law;

Considering that, given the urgency, it is necessary to apply Article 149 of the 1987 constitution.

Accordingly, require State authorities to provide for the replacement of Mr. Jocelerme Privert Provisional President in accordance with Article 149 of the Constitution of 29 March 1987, in order to safeguard national sovereignty."
