Haiti - Elections : Position of Ambassadors accredited to Haiti 13/12/2010 09:07:15 The International Community notes the decision of the Provisional Electoral Council to set a deadline for contestation of 72 hours from Monday, December 13 until Wednesday, December 15, 2010, to allow all candidates to submit their applications at the instance of legal disputes before the final count of votes. [HL] Once again, the Provisional Electoral Council takes liberties with the electoral law in particular Article 178 (note 1) which states that the deadline for contesting of 72 hours begins after the posting of results, which it is requires by the CEP in Article 174.2 (Note 2) and not when the CEP decides. Although the CEP is in theory the sole authority to decide, that does not put this organization at the top of the law. The international community encourages the use of all legal avenues to advance a credible electoral process to ensure that the final results fully reflect the will of the Haitian voters in transparency and respect for the constitution. It reiterates its invitation to all candidates to use their legal remedies available to them by the electoral law. The International Community also notes the proposal for the establishment of a Special Commission of Audit by the CEP and invites all stakeholders to take part in the process of establishment of the Commission. Noting that Article 31 of the Haitian Constitution guarantees "the freedom of association and assembly without arms for political, economic, social, cultural or any other peaceful purposes" the international community deplored the violence [at least 5 dead and 20 injuring] which, among others, have crippled economic activity, prevented the schoolchildren and students to pursue their courses and, more tragically hampered the fight against the cholera epidemic. The International community exhorts consequently all the candidates for being worthy of their responsibilities and to ask their supporters to refrain from resorting to violence, whose only victim is all the Haitian people. (1) : Article 178 A candidate or his representative may contest, within seventy-two (72) hours after the posting of the results under section 174.2, the election of another candidate: a) if the vote, the vote count or the drafting of the minutes were done improperly and contrary to this Act; b) if there was electoral fraud. (2) : Article 174.2 The Director General, after having receiving from the Director of Operations Electoral the election results, transmit them to the Permanent Electoral Council for display in the BED and BEC and their publication in the press.
