Haiti - Elections : An Update, few hours before the final results
Just a few hours before the publication of the final results of the first round, the country lives in uncertainty and the population apprehends the reactions of the losers... While these results should be released today, according to the schedule published by the Provisional Electoral Council (CEP) political actors show different positions.

For Mirlande Manigat, winner of the first round (preliminary results), there is no doubt, the games are done since publication of the press release of the platform INITE announcing the withdrawal of Jude Célestin "now I know that my competitor in the second round will be Michel Martelly" had declared the candidate in the aftermath of this release. The candidate wishes that some unsuccessful candidates, join her camp in the perspective of an integration within her Government.

Michel Martelly asked to his supporters to remain mobilized in order to make respect the will of the population, a will which for him, is the same as that of the Organization of American States (OAS)... His supporters call for respect of the recommendations contained in the report of the expert mission of the OAS which places Michel Martelly in the second round in place of Jude Célestin and are ready to take the streets if necessary...

For the opposition, the end of the mandate of President Rene Preval is February 7, 2011. Yesterday, a demonstration has gathered hundreds of people who demanded the cancellation of elections and the departure of the Head of State. It would be a beginning of mobilization that should lead to a major national mobilization on February 7...

Jude Célestin defers to the decision of the National Electoral Challenges Office (BCEN). His supporters are opposed to any abusive decision against their candidate. Osner Févry, one of the lawyers of Mr. Célestin, fears that the electoral judges render a "political" verdict unfavorable Célestin. In the event of this kind of verdict, the lawyer intends to refer the case to the Court of Cassation, sweeping the fact, that the decisions of the Provisional Electoral Council are the latest instance. He would not rule out the possibility of a complaint for forfeiture against the electoral judges if asked by Jude Célestin...

The questions now is whether the CEP is aligned on the recommendations of the OAS or if on the contrary, the CEP remained firm on the ranking of the preliminary results of the first round...

Victor Benoit, Fusion leader, is opposed to the continuation of President Préval after February 7 accusing to be unconstitutional the law passed by parliament that recognizes to the Chief of the Government the right to stay until May 14, 2011, the date of her swearing.

Evans Paul, meanwhile, expresses the hope that a transitional government approved by a majority of the population takes the reins of the country following the February 7, 2011.

Recall that the amendment of Article 232 of the Law, allowing the extension of three months the mandate of the Head of State, had been approved by the lower chamber (56 votes, 3 against and 3 abstentions) and Senate (14 favor, 0 against and 2 abstentions). This vote confirms that the departure of President René Préval is linked to the entry to a new democratically elected President, may not exceed the date of May 14, 2011.

It is said in the backstage that René Préval should have "threatened" the International Community after February 7 in order to get the full support of the latter to his hold on power after February 7, as the amended Law allows. To date, nothing suggests a transfer of power between President Préval and a judge of the Court of Cassation. The Head of State seems to have the support of the international community. Foreign diplomats refused to comment on the deadline of February 7.

Mirlande Manigat, remains open to maintain to power the Head of State after February 7. She expressed reservations about the formation of a transitional government, believing that there is currently no "credible alternative" and that we must avoid political unrest in addition to social unrest. "I am for compliance with the prescribed of the constitution, but not against a political solution that would allow President Préval to organize the second round [...] he must still give guarantees of his departure before May 14"
