Haiti - Justice : CARDH recommends to Moïse to shorten his mandate !
The Center for Analysis and Research in Human Rights (CARDH) produced a non-exhaustive report on the state of human rights in Haiti for the year 2019, which, while considering the global context, finds in governance term "[...] disinterestedness in human rights; consolidation of corruption; the weakening of institutions; failure to respect the principles of democratic governance; state crime through the use of armed groups and the 'mercenarization' of the country and the inadequacy of public institutions [...]"

"[...] The few actions taken by public authorities prove to be insufficient and unconvincing, due to obstacles arising from the nature of the institutions or the President's desire to vassalize them. Political agreement proves necessary, given the aggravation and the complexity of the situation […]" Consequently, CARDH recommends "[...] that the President limits his mandate to February 7, 2020, after serious negotiations from the top level" stating that the Marriott agreement can be used as a source document.

CARDH recommends institutionally :

  • Adopt measures to complete inclusive, transparent and participatory general elections;
  • Adopt a budget for the year 2019-2020, based on an austerity policy and an efficiency approach;
  • To strengthen and harmonize, with a view to efficiency, the relationships between the institutions for fighting corruption (the Unit for Fighting Corruption (ULCC); the Superior Court of Accounts and Administrative Litigation (CSC/CA); the Central Financial Intelligence Unit (UCREF); the Financial and Economic Affairs Brigade (BAFE); the General Inspectorate of Finance (IGF); the Bank of the Republic of Haiti (BRH) and the Prosecutor's Office );
  • To publish the CSC/CA report on the remaining 25% of the PetroCaribe fund;
  • To audit the public administration;
  • To reform the Prosecutor's Offices so that they are independent;
  • Create a task force at the level of justice entities to carry out the trials of the massacres perpetrated in the country (2018-2019) and to compensate the victims;
  • To reform the Superior Council of the Judicial Power (CSPJ) legally and financially;
  • To strengthen the Interministerial Committee for Human Rights (CIDP);
  • To strengthen the General Inspection of the PNH (IGPNH) so that the latter becomes an independent and financially and administratively autonomous entity capable of controlling and sanctioning."
