Haiti - Justice : ULCC launches outreach campaign about the new law against corruption 26/07/2014 10:26:29
The Unit for the Fight against Corruption (ULCC) has launched a national outreach campaign around the law on the Prevention and Repression of Corruption published May 9, 2014 in the Official Journal #87 "Le Moniteur". This law is derived from the application of the first axis of the National Strategy for Combating Corruption (SNLCC), which includes, among other actions, the harmonization of the Haitian legislation with the United Nations Convention against Corruption (UNCAC), ratified in May 2007 and the Inter-American Convention against Corruption (ICAC), ratified in December 2000. This long-awaited law leaves no room to fraudsters and considers as unlawful acts inter alia : Ia bribery, illicit enrichment, laundering of proceeds of crime, embezzlement of public property, abuse of position, payoff, kickbacks, over-invoicing, influence peddling, nepotism, insider trading, illegal procurement, unlawful taking of interest, abuse of social goods, the favoritism, bribery of foreign public officials and officials of public international organizations and the suppression of unlawful banking practices and other acts qualified as such by law, subject to punitive sanctions more severe. Download the full text of the law (PDF) : https://www.haitilibre.com/docs/loi_portant_prevention_repression_de_la_corruption-mai-2014.pdf The campaign, which will run from July 2014 to August 2015, throughout the national territory, plans to sensitize all persons covered by this Act at the level of 10 departments of the country so that no one pretext ignorance. Training sessions and awareness around the law are provided for the Judges, Commissioners of the Government and substitutes, Lawyers, Judicial Police Officers (OPJ), Agents of the Public Service, Senators, Deputies and new elected officials issued from the next election. In addition, the ULCC organize a national tour of awareness and popularization (Phase I) in the North and the South, from 23 July to 8 August 2014, to present and explain the preventive and repressive measures relating to alleged offenses. The enactment of this Act, that allow to better prevent corruption, strengthens the capacity of oversight institutions of control and prosecutions thanks to the new offenses in force in the Haitian legislation that punish both corrupted and corruptors.
