Haiti - Justice : Annual Report on the situation of human rights in Haiti
The Annual Report on the Human Rights Situation in Haiti acknowledges that Haiti has made important steps towards the promotion and protection of human rights, while at the same time highlighting shortcomings in the judicial system, the excessive use of force by state agents and the worrisome situation of thousands of people of Haitian origin, or regarded as Haitians by the Dominican authorities, returned or deported to Haiti.

The Annual Report, covering the period July 1st 2014 - June 2015, highlights that - for example - advances have been made in relation to the protection of children against trafficking, prostitution and pornography. At the same time, the report underlines several human rights weaknesses, making particular reference to the increase of the country’s prison population as well as the inhuman and degrading treatment suffered by prisons’ inmates, a situation described as alarming.

With regards to the relations between Haiti and the Dominican Republic over the period taken into consideration, the report emphasizes that the situation for thousands of Haitians remains critical.

In relation to the extreme slowness of judicial proceedings related to serious violations of the past, such as the trial against Jean Claude Duvalier and codefendants, the report highlights how this represents an obstacle in the fight against impunity.

In light of the many human rights challenges highlighted in this report, but also emphasized by a number of international and regional bodies, as well as UN experts, the Human Rights Section of MINUSTAH and the United Nations High Commissioner for Human Rights (HRS) makes a number of recommendations to the Haitian State, including:

- to avail itself of the expertise of OHCHR and MINUSTAH, the United Nations, the international community and various human rights organizations in order to implement recommendations made to Haiti, in particular by Human Rights Council’s mechanisms, United Nations Treaty Bodies, the Independent Expert on the situation of human rights in Haiti and other special procedures of the Council;

- to avail itself of the expertise of the special procedures of the Human Rights Council, in particular the Working Group on Arbitrary Detention, the Special Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment and the Special Rapporteur on the independence of judges and lawyers, to fight against prison overcrowding and prolonged pre-trial detention;

- to consider to become party to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment as well as its Optional Protocol establishing a system of regular visits uby independent bodies to places where people are deprived of their liberty, in order to prevent torture and other cruel, inhuman or degrading treatment or punishment;

- to avail itself of the expertise of the Special Rapporteur on the promotion of truth, justice, reparation and guarantees of non-recurrence in its efforts to implement judicial and non-judicial measures to address serious violations of human rights committed in the past, particularly during the presidency of Jean Claude Duvalier.

The Annual Report is submitted to the Haitian Government for follow-up with a view to encourage it to take action and ensure respect for human rights in the country.
