Haiti - FLASH : Danton Léger will not be able to hear J-B Aristide
Following the request of the Government Commissioner Jean Danton Léger, to put at the disposal former President Aristide in order to shed light on his statments describes as incitement to violence https://www.haitilibre.com/en/news-19223-haiti-flash-danton-leger-requires-the-making-available-of-aristide.html , Senator Jean Renel Sénatus, former Chief of the Port-au-Prince Public Prosecutor's Office and Chairman of the Justice, Security and National Defense Committee of the Senate, strongly reacted in a letter addressed to the Minister of Justice Camille Junior Edouard, "to put pressure" and to avoid that regrettable incidents happen before the elections.

Extracts from the correspondence of Senatus to the Minister :
"The Commission [...] hastened to request your urgent intervention with the public prosecutor's offices with a view to adopting measures to promote peace and tranquility [...] Indeed, Mr. Minister, this morning, the Committee read a correspondence addressed by the Commissioner of the Government of Port-au-Prince to his counterpart at the Court of First Instance of the Croix des Bouquets asking the latter to put at his disposal former President Jean Bertrand Aristide on 16 November 2016.

Without questioning the substance of the approach which might be lawful and without wishing to interfere in judicial matters under the principle of the separation of powers, the Commission considers the action inappropriate because of the serenity required for the safeguarding and the maintenance of public order in this pre-electoral period.

The Commission therefore recommends you Mr Minister to take the necessary security and administrative measures to ensure that no act disturbs the elections of 20 November 2016 [...]"


In the wake of this correspondence, the Commissioner of the Croix des Bouquet did not delay in sending a negative reply to Jean Danton Léger's request :

Extracts from the reply of the Government Commissioner of Croix-des-Bouquets :
"[...] following your request, the Government Commissioner of the Court of First Instance of the Croix des Bouquets has the advantage of informing you that a favorable decision can not be given to your request on the following grounds :

1- Since the Provisional Electoral Council, the competent authority in this matter, is already seized of the case, the Public Prosecutor can not seize the case in turn;

2- This request is inappropriate in the circumstances given the constant need for serenity required by the electoral process;


3- As a public authority, any measure or decision that is likely to disturb the electoral atmosphere or public order should be avoided;
[...]"
