![]() Haiti - Elections : CEP call to order 23/11/2016 08:53:14
It is categorically forbidden for any candidate or party to declare himself the winner of the election before the official publication of the results by the CEP. In addition, any public demonstrationt in favor of one or more candidates, one or more political parties or groups, is prohibited from polling day until the official proclamation of the results, this, under Article 123 of the Decree. The CEP calls the population calm and invites them not to respond to provocations or give in to incitement to violence. Articles of the Electoral Decree : Article 123 : "Any public demonstration in favor of one or more candidates from one or more political parties or groups, is prohibited from election day until the definitive results are proclaimed." Article 197 : "Is punished by imprisonment from six (6) months to one (1) year and a fine of ten thousand (10,000) to twenty-five thousand (25,000) gourdes, the fact by any person to organize or participate in a public demonstration in favor of one or more candidates, one or more political parties or groups deom polling day until the proclamation of the results." Article 197.1: "Is punished by a fine of thirty thousand (30,000) to one hundred thousand (100,000) gourdes, the fact by any person to publish electoral predictions concerning the conduct of the poll or to publish electoral prognostics realized by anybody on polling day." Article 226.1 : "In no case, the observers can publish in the press or otherwise partial results or the tendency of the vote before the official publication of the Provisional Electoral Council, under penalty of being prosecuted before the competent court for infringement of the Electoral Act."
