Haiti - Justice : Motorists are not all equal before the Police

Renan Hedouville, the Protector of the Citizen, draws to the attention of all the components of the State, more particularly the President of the National Assembly, the Prime Minister, the President of the Superior Council of the Judiciary, the Minister of Justice and of Public Security, the Minister of the Interior and Territorial Communities and the Director General of the National Police of Haiti, on the systematic discrimination of motorists and violations of Articles 1 and 7 of the Universal Declaration of Human Rights. Man who want that "All human beings are born free and equal in rights" and that they are "All equal before the law and are entitled without any distinction to an equal protection of the law."

Hédouville denounces that the agents of the National Police of Haiti (PNH), for violations including articles 21, 22, 23, 34, 35,40, 43, 96, of the decree of May 26, 2006 on registration and circulation vehicles, punish with the last rigor the citizens whereas at the same time, constituted authorities and / or relatives of these authorities commit these same infractions with impunity and without being worried. Clinging not only to the principles of respect for human rights, but also to the definition of the Rule of Law which is a "Principle of governance under which all individuals, institutions... including the state itself have to answer for the observation of the laws promulgated publicly and applied in an identical way for all..." the Protector of the Citizen "recommends that the State authorities take all necessary steps to ensure that the law is applied impartially against all, without distinction. Whether it is a police officer driving his personal vehicle without a license plate, an up-to-date license plate, and / or without an Insurance Policy, whether it is a personality or a circulating authority on board and / or with vehicles without a license plate or those who, under the pretext of being part of the Judiciary, apply on their vehicle signs, stickers with the mention "Justice" and believe themselves above traffic laws and regulations, whether it be those who, in one way or another, believe they are allowed to drive in their private vehicle with siren and / or beacon." concluding that the application of these simple recommendations is imperative pending further action.
