Haiti - FLASH : Federal Judge prevents Trump administration to cancel TPS

Wednesday, as part of a lawsuit filed by immigrants with temporary protection status (TPS), US District Judge (California) Edward Chen granted a preliminary injunction temporarily barring the Trump administration from implementing a plan to end the temporary protections granted to more than 300,000 immigrants to the United States, including from El Salvador, Haiti, Nicaragua and Sudan, while a lawsuit challenging the Government's decision to eliminate their protections, was in progress.

In his decision, Judge Chen writes that "The government has failed to establish any real harm if 'the status quo' is maintained during the pendency of this litigation," adding that "plaintiffs and amici have established without dispute that local and national economies will be hurt if hundreds of thousands of TPS beneficiaries are uprooted and removed."

Following this decision, Marleine Bastien, Executive Director of the Family Action Network Movement (FANM), said, "This decision is a great news. I commend Judge Chen for his courage and thank him for the relief he has given to hundreds of thousands of families, including their children born in the United States, of the specter of family separation that threatened them [...] We hope that this decision will allow us to continue our efforts to find a permanent solution for these 300,000 families [...]"

Reminder of TPS expiry dates :

Sudan: 11/2/2018

Nicaragua: 1/5/2019

Nepal: 24/06/2019

Haiti: 22/07/2019

El Salvador: 9/9/2019

Honduras: 1/5/2020

To follow, because Trump will certainly use all the remedies available to him against this suspensive decision...
