Haiti - Social : The SJR Haiti condemns the violation of rights of 85 Haitians repatriated
The Jesuit Refugee Service (SJR Haiti) has witnessed on Wednesday, April 27 between 7:30am and 8:00am to the repatriation of 85 Haitian, including a dozen young women and one minor, at the Toussaint Louverture International Airport in Port-au-Prince. These Haitians, whose 36 had been intercepted at sea in a boat people near the Caribbean island, were detained by Bahamian authorities before being repatriated to Haiti's capital aboard Bahamas Air.

The Jesuit Refugee Service (SJR Haiti) strongly condemns the violations of human rights of the 85 Haitians repatriated by the authorities of the Bahamas. Many of these Haitian nationals have been separated from their parents, their spouses and their children who are left alone in Nassau, according to testimony gathered by the SJR near the repatriates. The majority of returnees have not been able to recover their property and their salaries before their repatriation. The repressed, that is to say, those who were captured at sea near Inagua, have experienced bad-treatment by agents of the Immigration.

The SJR Haiti doubts whether the Bahamian immigration authorities have respected the right of Haitian nationals to a "trial in due form" before issuing the order of repatriation, since some of the Haitian returnees have lived before their deportation for more than 10 years or 21 years, on the Bahamian territory.

Faced with this situation, the SJR demand:

1) to the Governments of various countries of the American continent to grant a moratorium on the repatriations of Haitian nationals, given the worsening of the humanitarian situation in the country since the devastating earthquake of January 12, 2010 and due to the absence of conditions and structures that can accommodate those repatriated in Haiti and help them to reintegrate into society.

In this context, the deportations of Haitian nationals towards Haiti by the states and governments of countries, including the Bahamas, the United States of America, the Dominican Republic, constitute violations of international human rights instruments, including the right to life and the dignity of the returnees.

2) to the Haitian authorities to urgently address the situation of Haitian migrants who experiencing a difficult fate in several countries of the American continent, such as the United States of America, the Dominican Republic, Bahamas, Peru, Brazil, French Guiana, to name a few.

The stock of the situation of Haitian migrants in America is becoming darker because it is largely marked by the resumption by some States of the continent, of the deportations of Haitian nationals and by the decision by other states to close their borders to Haitians and to toughen their policy on migration and asylum against this minority.

"The Department of Immigration of the Bahamas resumed the arrest and repatriation of Haitian nationals from Wednesday 1st September, and procedures that had been suspended for logistical and humanitarian reasons following the devastating earthquake in Haiti in January", had announced briefly and without explanation, in early September 2010, the Director of Immigration of The Bahamas Jack Thompson.

Each country has the right to protect its territory, but all this must be done within the framework of law and respect for the human person. The SJR Haiti deplored the conditions under which these repatriations are realized. It calls on Haitian authorities to take position on the non-respect of human rights and dignity that many countries continue to practice against Haitians, especially minors separated from their parents who may be victims of trafficking and smuggling.
