Haiti - FLASH : The BMPAD claims $194M to SOGENER S.A. but what is the reality ?

Friday, October 18, 2019, the Office of Monetization of Development Assistance Programs (BMPAD) sent a summons of justice to the company SOGNER S.A., led by Jean Marie Vorbe (owner) and Dimitri Vorbe, to claim it within 3 days the restitution of US$194 million for the petroleum products credit purchase (PetroCaribe Program) for the period from June 2012 to March 2019

"[...], in three clear days, for any delay, pay to BMPAD in the hands of his lawyer, named above, in the Cabinet of the one having charge of power to ask the SOGENER good and valid receipt, of the following values:

- USD 194,507,067.19 value representing the total amount of PetroCaribe Petroleum Credit Purchase for the period from June 2012 to March 2019 (Bills and Statement of Account):

[...] Formally declaring to the SOGENER that failing to comply with this summons within the time limit, that passed, it will be done against it what law provide [...]" on reads in the summons

What is most surprising in this summation is that the BMPAD seems to ignore the existence of cross-debts between the Haitian State and Sogener and that in fact it is the Haitian State that is still debtor of a little more than 8 million dollars to SOGENER S.A.

Indeed, as of September 30, 2019 the Haitian State owed the Sogener a little more than 202 million dollars (202,765,290.16) and and the SOGENER SA owed to the State a little more than 194 million (194,104,795.05) as it appears on the documents made available by SOGENER : the statement of accounts and the value of fuel delivered to SOGENER S.A. by BMPAD on behalf of Electricity of Haiti (EDH)
