Haiti - NOTICE : The work of writer Jacques Stephen Alexis will not fall into the public domain in 2021

The Haitian Copyright Office (BHDA) of the Ministry of Culture, informs the general public, publishers, producers, screenwriters, that the work of the writer Jacques Stéphen Alexis (April 22, 1922 - died in April 1961) will not fall into the public domain in 2021.

The BHDA recalls that according to article 20 of the Decree of 2005 on copyright and neighboring rights provides "the economic rights to a work are protected for the life of the author and 60 years after his death."

However, the BHDA specifies that in the case of Jacques Stéphen Alexis his death has never been noted or attested. Moreover, to date, Alexis has not been the subject of any judgment in absence or in disappearance marking the starting point of the "post mortem" protection period. As a result, this deadline, which has never officially started to run, cannot end in 2021, says the BHDA.

The Office whose mission is to ensure the defense of the material and moral interests of authors and performers of intellectual creations, to guarantee the protection and exploitation of the rights of creators of intellectual works, warns all those who would be tempted to print, to popularize for their own benefit, without authorization, the work of Jacques Stephen Alexis.
