20 US states (Texas, Alabama, Alaska, Arkansas, Florida, Idaho, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, Ohio, South Carolina, Tennessee, Utah, West Virginia and Wyoming) ruled by Republicans, oppose the Biden-Harris administration's new Conditional Stay Program, which grants 30,000 permits per month to nationals of Cuba, Haiti, Nicaragua and Venezuela hhttps://www.haitilibre.com/en/news-38566-haiti-flash-new-us-entry-program-for-haitian-migrants-conditions-and-steps-to-follow.html and filed suit in court against the Department of Homeland Security (DHS) to demand the end of this program which it considers illegal

The plaintiff states believe that DHS "[...] circumvented Congress and created a de facto visa program without legislative approval." They also claim that "the program goes beyond the limited circumstances in which DHS is authorized to use conditional humanitarian stays under federal law..."
