Haiti - Anti-Corruption : Haiti’s intervention at COSP-10
Speech delivered by Me Hans Jacques Ludwig Joseph, Director General of the Anti-Corruption Unit (ULCC) at the 10th Conference of States Parties to the United Nations Convention against Corruption (COSP-10) held in Atlanta (USA).

Speech by Me Hans Jacques Ludwig Joseph :

"Mr President,
Distinguished members of the different delegations,

The Republic of Haiti is honored to participate in the tenth conference of States Parties to the United Nations Convention against Corruption. I congratulate the President on his election to chair our work.

Mr. President,

Over the past 20 years of the Convention, significant breakthroughs have been made. I want to emphasize that since its ratification, the Haitian State has equipped itself with a legal and institutional arsenal to prevent and fight against corruption. This very year, the Republic of Haiti adopted new legislation, notably on money laundering, a new customs code and a new tax code https://www.haitilibre.com/en/news-37379-haiti-economy-towards-the-adoption-for-the-first-time-in-haiti-of-a-general-tax-code.html . These three instruments reaffirm the desire of the Haitian State to join the international community to combat corruption which is a threat to democracy, peace and the rule of law.

The Haitian State, through the Anti-Corruption Unit, has intensified its actions to prevent corruption by focusing on education and awareness raising among young people, as well as on the involvement of society actors. civil. It is more than essential that this young generation decides to adopt a culture of intolerance to corrupt practices and subversive, unethical attitudes.

We have adopted a Code of Ethics applicable to investigators in accordance with the Convention. The Superior Council of the Judicial Power has also published a Guide to the ethics of magistrates with a view to promoting judicial integrity.

Furthermore, the Haitian State is working towards the signing of an Integrity Pact between private sector actors. Last September, meetings were organized around the role of this sector in the fight against corruption. The ULCC, also, the National Commission for Public Procurement to prevent and manage conflicts of interest in public procurement has established the best practice of identifying the effective beneficiaries of public procurement.

On the repressive side, decisive steps have been taken. Over the last three years, the ULCC has produced and transferred to the courts 42 criminal investigation reports establishing significant acts of corruption to the detriment of the State. Funds were frozen and custodial and restrictive measures taken. One hundred and twelve requests were sent to public prosecutors with a view to prosecuting influential political figures for failure to declare assets. These are unprecedented actions which explain the determination of the Haitian Government to clean up public life. An Anti-Corruption Circuit which represents the first judicial center specialized in the processing of corruption cases has been established.

On the other hand, the Government, following the recommendations made during the last review cycle, has developed two essential draft laws. These are the preliminary bill on free access to information and the one aimed at protecting, among other things, whistleblowers.

Ladies and gentlemen,

The fight against corruption remains at the heart of our national concerns. The country continues its actions for the proper application of the Convention, multiplying and combining efforts in order to impose transparency in public management. I am delighted with the accession of the Haitian Government to the GlobE Network which will strengthen our actions to detect and repress corruption. I call for international cooperation in this sphere which could result in the strengthening of digital investigation capacities and a technical assistant relating to the recovery of assets in favor of developing countries which are primarily suffering the consequences of this global scourge.

Finally, Haiti welcomes this theme chosen by the United States relating to accountability because for our part, we are currently taking crucial actions to hold accountable those who, through the practice of corruption, undermine the laws of the Republic. and impose themselves as an obstacle to the development of the country.
