Haiti - FLASH : Removal of TPS, first legal defeat for the Trump Administration

On Monday, March 31, 2025, California Federal District Judge Edward Chen suspended Secretary of Homeland Security Kristi Noem's decision to terminate the Temporary Protected Status (TPS) program https://www.haitilibre.com/en/news-44324-haiti-flash-end-of-tps-in-august-2025-opening-the-door-to-the-expulsion-of-haitians.html , which protects beneficiaries from the deportation of, among other things, some 350,000 Venezuelans to the United States.

"The Court finds that the Secretary's action threatens to: inflict irreparable harm on hundreds of thousands of persons whose lives, families, and livelihoods will be severely disrupted, cost the United States billions in economic activity, and injure public health and safety in communities throughout the United States," the judge's decision reads.

The document also states that the U.S. government has failed to demonstrate that continuing to grant this temporary protection to Venezuelans would cause substantial or adverse harm that would justify suspending the program.

Last week, TPS beneficiaries for Venezuela and Haiti, through the National TPS Alliance, requested that the White House reverse the termination of immigration protection in the coming months.

Let's recall that this protected status is granted to citizens of designated countries due to conditions such as armed conflict, natural disaster, or other extraordinary circumstances that prevent safe return to their home country.
