Haiti - Social : Repatriation of Haitian outside the respect of rules and people

Following the illegal repatriation, on November 1, of 142 Haitian migrants at the border gate of Elias Piña/Belladère the Jeannot Success Border Network (RFJS) for the Promotion and Defense of Human Rights, in a statement, regrettes that the Directorate General of the Dominican Migration continues to repatriate Haitians in inhumane conditions (bus with barred windows), which does not respect the dignity of people.

Stating that "[...] the only immigration policy that applies to the General Directorate of Migration to control the flow of migration is the expulsion, by ignoring other principles relating to the Migration law 285-04 and its regulation 631-11."

The RFJS stressed that repatriation procedures duly established are ignored: any form of repatriation is given to people reconducted ; the Haitian authorities are not notified. "This shows that these repatriations are made in violation of rules of regular procedures, which apply to all types of judicial and administrative actions and violation of the fundamental right to effective judicial protection [...] We are witnessing of the systematic failure on the part of the migration, of international agreements signed by the Dominican Republic in the field of human rights and the rights of migrants, as well as the absence of the implementation of Regulation 631-11 for application of the Act Dominican migration."

In conclusion, the RFJS urge the Dominican authorities to reactivate and strengthen the channels of collaboration between government and civil society to introduce improvements in legislation and ensure that it becomes an effective and humane instrument.
