Haiti - Politic : Article 12 of the El Rancho agreement as a solution for unlocking the Senate ?
The 6 senators of the minority of opposition continue to block the ratification of the amendment of the electoral law of 2013, despite the signing of the El Rancho agreement that commits the Parliament to ratify the amendments agreed, ratified by the lower house unanimously Tuesday 1 April. https://www.haitilibre.com/en/news-10847-haiti-politic-the-chamber-of-deputies-voted-the-electoral-law.html

Recall that last Wednesday Dieuseul Simon Desras, Senate President acknowledged that the Assembly was unable to work on amendments to the electoral law, as proposed in the context of the El Rancho agreement, remarks that were in response to pressure and the intransigence of 6 Senators of the opposition, claiming the dissolution of Transient College Permanent Electoral Council (CTCEP) and the establishment of a Provisional Electoral Council (CEP) in accordance with prescribed in Article 289 of the Constitution, or a Council composed of representatives of 9 sectors of national life, contrary to the requirements of agreement El Rancho. Several legal experts believe that the requirement of these senators is highly political.

Monday senators of the Group 6 (G6) met a delegation composed of several officials of member parties of the "Patriotic Movement of Democratic Opposition" (MOPOD), which includes the main opposition parties and conditioned the formation of the CEP as a prerequisite to ratification of amendments of the electoral law.

Mirlande Manigat, the Secretary General of the Rally of Progressive National Democrats (BDR) which is part of MOPOD stated that the opposition shared the position of G6 "We are committed to support the position of the senators demanding the formation of a CEP according to constitutional requirements," she says, the approach of the parties through the events and actions of parliamentarians fall within the framework of efforts aiming the best interests of the Nation...

Also Tuesday, the delegation of 23 political parties, who took part in the dialogue inter-haitian gathered designated by consensus : Osner Févry of the National Coalition of Political Parties Non-Aligned of Democratic Centre (CONACED), Jeantel Joseph of the National Consortium of Political Parties, and Joseph Enold of the Konvansyon inite demokratik (KID) to replace the three members of the Monitoring Committee have integrated the Government of openness and effectiveness of Government (Rudy Hérivaux appointed Minister of Communication, Himmler Rébu appointed Minister of Youth, Sports and Civic Action and Sully Joseph appointed Minister Delegate to the Prime Minister, Responsible for Strengthening Political Parties).

According to the Minister Rudy Hériveaux, which Tuesday at this meeting, under leader of "Konfyans", we can not continue to let them take the country in hostage to satisfy "the whims of some and the hard-line of others," recalling that to unblock the situation if it is necessary "[...] we will have to open the doors of Article 12 and allow the electoral machine to reach its cruising speed [...]" For Rudy Hériveaux in a democratic country, there is only one way to take power "it is through elections".

Enold Jossph (KID) Member of the Commission stated that the Monitoring Committee would meet G6 "We will discuss with them to see how they can vote the document" In case of failure the Commission will see what can be done, leaving the door open to the application of Article 12, which provide for a blocking states : ""In cases where amendments to the electoral law provided and proposed in the dialogue are not passed by the two branches of Parliament within the period prescribed in section eight (8) of this Agreement, the Parties recognize with the Provisional Electoral Council (CEP) the physical impossibility of applying Articles referred. Consequently, the Parties agree that the said articles are automatically on hold and the electoral body is allowed to override."
