Haiti - FLASH : Note of protest against the political persecution, gives results ! 02/06/2016 06:31:54 "The members of the MARTELLY-LAMOTHE and MARTELLY-PAUL administration, ignatories of this, raising their most vehement protest against the measures restricting freedom they are subject by the Government Commissioner of Port-au-Prince, Me Jean Danton Léger, cting on behalf and under the orders of the administration PRIVERT-JEAN CHARLES, without reasons or justifications. After having makes noted by the Justice of the Peace of the Eastern Section of Port-au-Prince the existence of these prohibitions to the Directorate of Immigration and Emigration dated 1 June 2016, they want to condemn these arbitrary measures, illegal, unconstitutional and undemocratic assimilated to political persecution. They inform the Haitian people in general and their supporters in particular, they have constituted lawyers to take all legal steps to enforce their fundamental rights to freedom of movement as guaranteed and protected by the 1987 Constitution in Articles 24 and by the various international conventions duly ratified by Haiti, including the American Convention on Human Rights dated 22 November 1969 in Article 22, paragraph 2, which states: 'Everyone has the right to leave any country, including his own'; the International Covenant on Civil and Political Rights entered into force on 23 March 1976, in Article 12, which provides : 'Everyone lawfully within the territory of a State shall, within that territory, have the right to liberty of movement and freedom to choose his residence... Everyone shall be free to leave any country, including his own' and finally, under Articles 27 and 27.1 of our fundamental charter that allows victims of such arbitrary acts to directly prosecute the perpetrators of such violations. "The prosecutor of Port-au-Prince inform the general public and interested parties in particular that it was decided to cancel the departure prohibition order issued against members of the former Government and those of the former Provisional Electoral Council pending the seizin of ordinary channels of prosecution," indicates the note signed by Me Jean Danton Léger, Government Commissioner.
