Haiti - Education : A lot of money in the FNE...
Dated January 21, 2015, for the sake of transparency, the CONATEL informs that within the framework of the National Fund for Education (FNE) for the period from 15 June 2011 to 21 January 2015, a sum of over USD$100 million ($ 100,324,489.32) from the tariff surplus on incoming calls in the country [0.5 cents per call] was collected or remains to be collected from telephone companies.

Thus, the CONATEL collected: 4,960,173.11 dollars of the Comcel, 82,195,391.78 dollars of the Digicel and 5,994,695.86 dollars of the Natcom. Note that Digicel and Natcom must pay to CONATEL respectively 6,171,030.40 and 1,003,198.17 dollars.

Recall that these levies, collected, in consultation with the phone partners are intended to finance the Universal Schooling Program Free and Compulsory (PSUGO) for the most disadvantaged in Haiti.

Note that these amounts do not include the fee of 1.50 US dollars, levied on incoming and outgoing transfers imposed by the Central Bank, under the FNE. For the period from June 2011 to August 2012 (the only data available...) the transfer fee collected by the Central Bank, amounted to 1.9 billion gourdes [± 45,238,095 US dollars].

Today, that amount should be around $132.69 million [estimate HL, calculated from the last known amount, based on a constant linear progression] representing an estimated total of just over $230 million, including the phone phone tariff surplus.

Recall that after more than 3 years since the FNE was launched (created in May 2011], the Senate never ratified the Bill on the establishment, organization and functioning of the FNE for using these funds for education. Note that the lower house passed the bill in August 2012 after amendments [15 months after the establishment of the FNE] and transmitted it to the Senate for ratification in the same terms, before its promulgation in the Official Gazette "Le Moniteur".

Despite this absence of ratification, the draft Finance Act 2014/2014 devotes an increase of 1.6 billion gourdes in the investment budget of the Ministry of Education who receives envelope of 2.3 billion gourdes whose 1.5 billion would come from the National Fund for Education.

Senator Jocelerme Privert, former President of the Senate Committee "Economy and finance" stated at the time that the use of resources of the FNE does not mean that the Parliament has authorized the operation of such a decentralized body, specifying that its operation should be subject to a law, reminding to that effect the Decree on the preparation and execution of the Laws of Finance of 16 February 2005, published in the #39 of Official Journal "Le Moniteur" on Monday, May 23, 2005, which states in Article 27 that "All the resources of the state are in fact budget revenues, even if they were not provided by the Finance Act. The resources of the State or any Public agency can only be created by laws, conventions, judgments or services rendered and must be paid in the Treasury account".
