Haiti - FLASH : Bombshell, Desras back to the Senate
Wednesday, Simon Desras Dieuseul whose term as Senator, had allegedly expired January 12, 2015, returned to the Senate restored to his post for Senator, by a court decision in his favor against the Haitian State, in the order of the judge in chambers Bredy Fabien made February 6, 2015.

Mr. Desras was accompanied by his lawyer Me Anibal Coffy, of a bailiff and the judge of Peace Fred Marie Legerme, , who confirmed that the mandate of the former President of the National Assembly was 6 years and was not expired January 12.

The Justice of the Peace, who provided a copy of the order to the General Secretary of the Senate for the purpose of enforcement, asked the Haitian state to instruct the public services and the Protocol Office to remove the reference of former Senator improperly attached to Senator Desras and allow him to enjoy the prerogatives attached to his Senator function.

Recall that the National Palace had informed the Senator Desras last month that his Senate term expired, but the latter was elected in 2011 in a special election, has always maintained that its mandate was 6 years years instead of 4 years, noting that it had benefited in April 2011, of a decision of the National electoral dispute office (BCEN) according to which he had been elected for 6 years, recalling that Article 191 of the electoral law then in force, stipulated that the BCEN decided in last resort.

Simon Desras Dieuseul had then seized the Tribunal of referred to assert his rights. On 29 February, the judge Brédy Fabien had heard the case between Simon Desras Dieuseul the Haitian State. During the hearing, the state's lawyers argued in substance, to support that Simon Desras was no longer a senator. It seems obviously that the arguments of the Haitian State in the eyes of the law, have not prevailed on the arguments and documents presented by the defense; Judge in his order of 6 February 2015 having agreed with Simon Dieuseul Desras, reversed the position of the National Palace and affirmed that the mandate of Simon Desras Dieuseul expired well in September, 2017.

"I won," declared Senator Desras "Now it's not just me who asks them to reinstate me, I have the law on my side."


Senator Desras said hoped that his presence will revitalize the Senate "Today, there is a silence about what is happening in the country [...] The agricultural students protested at the Ministry of Agriculture and nobody spoke on their behalf [...] there were two days of strike gas and no one in the Senate has said nothing [...]" adding "Nothing now works in the country, the economy does not work, the policy is not working, parliament does not work. The country is not governed."

Back at Grand Corps, Senator Desras now intends to recover its President chair occupied by his colleague Andrice Riché. If the latter considers this return as a very good thing, however, he clarified that he did not intend to cede its President chair to Senator Desras.
