Haiti - Jacmel : Resumption of judicial work... under tent
The judicial work resumed at the courthouse yesterday in Jacmel, Monday, October 4th, 2010. A Te Deum was sung in the Cathedral of Saint Jacques et Philippe of Jacmel. Several celebrities attended the ceremony, including Monsignor Launay Saturné, the Bishop of the South East, Gérard Borne, the consul of France in Jacmel, representatives of human rights organizations and staff of the Jurisdiction of Jacmel.

Following the Te Deum the delegation visited the courthouse located at the Hotel Manoire Alexandre under a tent.

Master Dougé Adeline François, Dean of the trial court in Jacmel who chaired the seance drew a good record of work done during the judicial year 2009 - 2010, despite the difficulties encountered in particular following the earthquake of January.

Master Adeline said that "the precarious conditions of the functioning of the courts are compounded by the damage that has been registered at the Civil Court of Jacmel. 179 cases were heard, including 42 civil cases, 62 corrections, 26 criminal cases without a jury, 16 criminal with jury, 25 cases referred, 3 abéaces corpus, and 5 adoptions" she said.

In his speech for the occasion, Master Mirlande Daphine, Government Commissioner to the prosecution of Jacmel, said the lack of staff within the prosecution, including a lack of judges and recalling that several of them are not paid until now, even if they work tirelessly. The Commissioner used the occasion to give the outlook for the new judicial year 2010 to 2011. They desire to the Minister of Justice and Public Safety Mr. Paul, and the Director General of National Police, Mr. Mario Andresol put at the disposal of the South East National Police, more vehicles, weapons and ammunition, an increase in the number of police officers so they can protect and serve the people effectively.

President of Bar of the College of Lawyers of Jacmel, Master Ronald Charles, on his side had set a final position of the Bar Association of Jacmel after the earthquake, with respect to many current problems, including the redevelopment of the building housing the courthouse severely damaged. This redevelopment plan includes at least two courtrooms and two other rooms to house the "Bâtonnat" and the Office of Legal Assistance of Jacmel (BAL), the creation of a Court of Appeal in the Jurisdiction of the Southeast, and the creation of a trial court in the town of Anse-à-Pitre or Belle-Anse, a necessity due to the population explosion in the department and the problems of transportation and communication that confront litigants.

Note that during his visit last July, in the metropolis of South-East, Mr. Paul Denis, Minister of Justice and Public Safety announced the rehabilitation of the courthouse in Jacmel, badly damaged by the earthquake. Three months later, no concrete action has not been undertaken and justice goes under the tent.
