Unlike BCED before the BCEN each party (prosecution and defense) has the right to speak only once to develop its arguments. Members of the BCEN measure may, however, require the parties the information required by the instruction. Former Senator Louis Gerald Gilles, at the origin of an appeal against the First Lady, Sophia Martelly candidate in the Senate, who claimed this week that his lawyer had new elements will be disappointed. Indeed before the BCEN, the challengers can not provide any further evidence to strengthen their prosecution case, than those already presented before the BCED "It is a principle of law that the call is a RETRIED. On appeal, one can not bring other new facts," explained Me Néhémy Joseph, member of the CEP. The only possibility for the parties is to develop a relevant and precise argument and hope to convince the Electoral Court of the merits of their arguments.
