Haiti - Elections : The Recommendations of the Commission of Electoral Evaluation
The report of the Independent Commission of Electoral Evaluation handed to President Martelly https://www.icihaiti.com/en/news-16224-icihaiti-flash-the-evaluation-commission-hands-its-report-to-president-martelly.html stresses that the complaints received clearly reflect that the electoral institution no longer enjoys the credit that would allow it to continue the process without danger to drive the country into even greater crisis

"Some documents requested by the Commission and promised by the CEP were not received in time for the purposes of evaluation, as agreed at the first meeting with the CEP. Because the transmission of certain documents of CTV required several authorizations that delayed the work.

General recommendations on the electoral process

The testimonies collected are unanimous in recognizing that the elections of 25 October 2015 were marred by irregularities and that several candidates have benefited from their representatives in BV of these irregularities assimilated to fraud. It is therefore necessary to have corrective and dissuasive measures for the continuation of the electoral process, knowing that in the current circumstances there are no perfect solutions. Thus after having led this evaluation t in accordance with the mission entrusted to it, the Commission, based on these findings of serious irregularities, proposes recommendations based on the results produced by the implementation of the adopted methodology. It has the honor to submit them as agreed in the decree of appointment of December 22, 2015, to the Head of State of Haiti for all suites helpful.

These recommendations are based on the will of actors involved in the current crisis to look deeply and quickly find a consensual solution to avoid a disaster in the country. They aim to :

a) To improve the electoral process;
b) To protect the structures and institutions of the country by soliciting from the different actors involved in the electoral process of 2015, a reasonable compromise;

c) Allow installation of confidence within the Haitian population for which elections are held;

d) generating a climate of peace to restore credibility to the electoral process and the institutions of country responsible for organizing or accompany the elections.
They should allow a political dialogue; fix responsibilities; make minimal changes in the electoral system; guarantee the truth of the next electoral ballot

For the continuation of electoral process it would be necessary the following immediate measures :

1. Given that Article 171-1 (first paragraph), which states "The Executive Directorafter having received from the Director of the Tabulation Centre of election results, transmits them to the Provisional Electoral Council which rdered their display in the BED and BEC right after checks", the Commission considers that the CEP is bound for the true and final responsibility to publish the results and not the lower courts of the electoral machine. That's why it strongly recommends that the CEP will make all necessary checks and indispensable before publication of the final election results.

2. During the whole time when the commission sat, it received a large number of complaints and denunciations of candidates in the last elections about the injustices they have suffered. There are even public disorders related to some of these cases. The electoral institution can not endorse injustice through BCED or BCEN whose we were told so much wrong of their judges. We even talked about corruption. The Commission recommends a revaluation and a thorough examination of these issues.

3. The Commission recommends the CEP to strengthen the supervision, control and sanctions on all the whell of the electoral machine and all phases of the process, to ensure that the different actors respect the provisions of the Electoral Decree and neutrality rules. Particular attention should be paid to the work of members of BV that have a broad power and great flexibility on election day.

4. The CEP should ensure proper training of members of different bodies contentious, BCEC, BCED, BCEN and prepare for them a document outlining the rules for implementing the provisions of the Electoral Decree.

5. The Commission recommends that the CEP no longer place voting centers in private homes and it greatly improves the working conditions of members of votes Offices: calculator, lighting. Some errors are due for example to a poor lighting.

6. The Commission recommends that the CEP make public the list of electoral observation organizations and the criteria for accreditation of election observers are more solid and serious.

7. Photos of the minutes taken by supervisors must be posted in each votes centers and sent to CTV and posted on the CEP website. In view of this the Commission strongly recommends that supervisors receive training and adequate resources.

8. For the second round of elections, provision should be made for the number of representatives is limited in each polling station. And members of the polling stations must ensure that the appendix of the representative's accreditation card is detached and that his thumb is marked with indelible ink after voting to prevent it from voting more than once.

9. The Commission recommends that is completely reconsidered the issue of recruitment and training of members of Polling Stations. The bloated human relay chain in the electoral process is in itself a problem, not a solution. The Commission considers that the members of BV should not be the temporary staff subject to the merciless influence of certain political actors.

10. Leaders of political parties should choose and properly train their representatives so that they are no longer possible perpetrators of electoral fraud. Any party representing who would to take advantage of its presence in the polling station or voting center to make propaganda for his candidate would be excluded from the voting center.

11. The various sectors having delegated a member to the CEP should consider seriously and carefully the accusations and suspicions of corruption against their members, if necessary, take the necessary arrangements for their resignation and replacement within 72 hours. This calls for a plastering of the CEP and also the electoral machine. This to safeguard the credibility and the continuation of the electoral process as soon as possible.

12. Members of the CEP and of the electoral apparatus that are the subject of complaint, must be put at the disposal of justice.

Politically

1. According to the stakeholders interviewed, the current crisis has a political dimension which requires political dialogue. It is highly desirable that they find an exit consensus honorable for all. This should lead to involve the other two branches of government within the political compromise that must be cleared to make a second round with the widest possible accession of the Haitian population.

2. The President of the Republic and the Head of Government should sit down with all the actors involved in the current electoral
crisis to find a consensus for the successful holding of the second round of elections.

3. Candidates for the second round must sign a pact or an agreement to moralize the electoral process and invite their supporters to refrain from any attempts to irregularities, fraud and / or violence.

Conclusion. The Commission carried out its work in accordance with its mission. Complaints received clearly reflect that the electoral institution no longer enjoys the credit that would allow it to continue the process without danger to drive the country into even greater crisis. The Commission believes that to continue the process and expect a significant turnout and social peace would require two things : a political dialogue between the various actors in the country and closer examination on the technical level of the responsibility of the electoral machine in the irregularities often assimilated to the massive fraud. "
