If the detention conditions in this prison are less severe than in other prisons or detention centers that I visited during my previous missions, overcrowding is not as high as in other prisons it still exceeds the 50% accommodation capacity,approximately: last Thursday [25 February 2016], there were in this prison 1,105 inmates while the capacity is about 760 people [...] There were only 330 convicted prisoners. The remaining 775 people were individuals in custody, or 70%. The average rate of remand prisoners in the country is 72% or 8,432 persons on remand on 11,649 prisoners. If we release or resolve the situation of persons in detention, prison overcrowding situation, which has a capacity for 4,000 people, would be immediately resolved. At the Croix des Bouquets prison he informs he met a prisoner who was in pretrial detention since December 2012, or over 3 years "He is accused of buying a gun allegedly stolen. If he was tried and convicted, this crime is punishable by a year and a half. He was never heard by a judge. Family visits in the prison have been suspended since September 2015. The reason provided to me is the situation of public order and public demonstrations motivated by the election results. It is not sufficient justification for depriving prisoners, for about five months, the right to receive visits from their families," affirmed the expert which stressed "there are also physical spaces of the prison that are not used as a pretext of difficulties to control the prisoners: a basketball court and a dining hall for about 150 people. It's irrational to maintain unused these places, that would certainly improve the quality of life of inmates and to develop user-friendly conditions in the prison. Compared to other prison facilities, the prison of Croix-des-Bouquets is better organized. Overcrowding is not as high as in other prisons where the situation is untenable. As I said, there is still a degree of overpopulation of 50%. The cells are designed to accommodate one person and can be found 12. [...] Certainly, there are concrete beds, that are not found elsewhere, but in these beds for one person, it accommodate twelve people.
