In a note, Me Jules Cantave, the President of the Superior Council of the Judiciary (CSPJ) informs of the holding of a meeting to the extraordinary on the current socio-political crisis and recalls among others, to the other two branches, that the judiciary is fully co-custodian of the national sovereignty.

"We, the President and members of the Superior Council of the Judiciary, Judges of the Cassation Court, President of Five (5) Courts of Appeal, Deans of eighteen (18) First Instance Courts of the Republic and on behalf of the judges and deputy judges of hundred eighty four (184) Peace Courts, gathered to the extraordinary at the headquarters of the Council to take stock of the big questions inspired by the nebulous socio-political situation.

In our capacity as authentic representatives of the Judiciary, fully co-custodians of national sovereignty, we are launching a patriotic appeal to the two (2) other Powers for the respect and strict application of Arts 59, 59- 1, 60 and following of the Constitution of 29 March 1981 amended May 9, 2011.

Moreover, in the current socio-political conditions, we, representatives of the Judiciary, urge each other especially political actors to demonstrate thought leadership, to avoid this announced catastrophe which, once again, would contributes to the degradation of the social climate and the deteriorating economic conditions of the population detrimental to our beloved Haiti.

What says the Articles 59, 59-1, 60 and following :

Article 59 :

Citizens delegate the exercise of national sovereignty to three (3) powers:

legislative power ;

executive power

judiciary power.

The principle of separation of three (3) powers is embodied in the Constitution.

Article 59.1 :

All these three (3) powers constitute the essential foundation of the organization of the State, which is civil.

Article 60 :

Each power is independent of two (2) others in its functions that it exercises separately.

Article 60.1 :

None of them can not, for any reason, delegate its powers in whole or in part, nor go beyond the limits set by the Constitution and by law.

Article 60.2 :

The entirely responsible is attached to the acts of the three (3) powers.
