Haiti - Justice : The CARLI outraged and revolted of actions of Me Danton Léger
In a note dated June 5, the Lawyers Committee for the Respect of Individual Liberties (CARLI), "notes with indignation and revolt that Me Danton Léger, Government Commissioner at the Court of First Instance, triggered a wave of political persecution against certain personalities [...] by takingclumsy departure ban measures against of former Prime Ministers, Ministers and other senior officials of government [...] Echoing unfounded accusations, fanciful and false regardless of the principle of the presumption of innocence enshrined in the Universal Declaration of Human Rights Article 11 stipulating 'Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defense.'"

While recognizing the importance of the fight against corruption in the framework of respect for human rights and building a the Rule of Law and a democratic society CARLI "recommends to the institutions concerned (Parliament, the Superior Court of Auditors and Administrative litigation, Central Unit of Financial Information, Unit for Combating Corruption) charged to investigate the management of funds of great servants of the State to fully assume their responsibilities to respond independently to the expectations of anyone wishing to obtain a clearance certificate of their management after objective and impartial analysis of the submitted dossiers."

Moreover, the day before the office of former Prime Minister Laurent Lamothe, took note of the cancellation of all Departure bans recently issued by the Procuratorate of Port-au-Prince against two former prime Ministers and several former ministers of the Martelly administration https://www.haitilibre.com/en/news-17613-haiti-flash-note-of-protest-against-the-political-persecution-gives-results.html

Recalling that "[...] the Government Commissioner holds no legal ground nor the jurisdiction to take such measures [...] The Office also notes the correspondence https://www.haitilibre.com/en/news-17635-haiti-politic-enex-jean-charles-wrote-to-the-minister-of-justice.html of
Prime Minister Jean-Charles Enex to the Minister of Justice and Public Security dated 2 June 2016 asking him to instruct all parquetiers to ensure that their actions are circumscribed in strict compliance with the law.

The office calls for the immediate cessation of the violation of human rights capable of opening the way for totalitarian drifts that could again plunge the country into the through of the period of the dictatorship." The Office "also like to extend its warmest thanks to all compatriots who have shown unfailing solidarity with Mr. Laurent Lamothe during this week in its struggle to restore the rights of the individual freedom of each citizen and Haitian citizen.
