Haiti - Justice : The agreement naming Privert President was never enacted
The Coordination of the Support Group to the Constitution (GSC) request in a letter to the Superior Council of the Judiciary (CSPJ), its assistance as third co-trustee power of national sovereignty, "on behalf of the principle and moral law commanding to fight any act, any law, all unconstitutional manifestly unconstitutional and illegal."

This correspondence is part of the continuity of the action for annulment of the agreement of February 5, 2016 https://www.haitilibre.com/en/news-16533-haiti-politic-the-details-of-the-agreement-from-a-to-z.html , initiated by the GSC and pleaded front the Dean Bernard Sainvil June 10, 2016 and the inventories of parts filed at the deliberations of the Dean August 24, 2016.

The GSC recalls the facts to the CSPJ advisers "At the end of the evocation and argument of the case, the Dean Bernard Sainvil, clearly indicated us that he will only render its decision on presentation of the agreement complained in its official format

Since all searches among State institutions or personalities to find a copy of Le Moniteur were unsuccessful. We approached amicably the Directorate of the Official Journal Le Moniteur which referred us to the National Palace. In desperation, we summoned the Director of the Journal Le Moniteur by bailiff, and we received again the address of the National Palace. Finally, we seized the jurisdiction of Peace of Petionville for its transportation to the directorate of the Journal Le Moniteur which finally admitted that the agreement of February 5, 2016 was never promulgated by the Executive or published in the official journal Le Moniteur, what the judge of Peace has documented in his minutes of observation. But, the publication in the Official Journal is a public order advertising requirement to give effect to any regulatory act, law, decree or order. (Articles 125, 125-1 and 144 of the 1987 Constitution).

In essence, this agreement, which has caused so much ink and saliva is deemed to be still in the drawers of the National Palace awaiting publication to be executed and since August 24, 2016, this folder is in the deliberations of the Dean Bernard Sainvil with an additional memory where we have highlighted to the judge that since February 6, 2016 Sieur Jocelerme Privert posed and continues to take actions that affect the lives of citizens and the interests of the Republic, including dismissal and appointment of civil servants, publication of orders, authorization of disbursement of funds from Public Treasury, signing agreements binding the State, all under a non-existent agreement [...]

We already expect that you will spare all effort to support the GSC and allow the Cassation Court to play the constitutional role it is entrusted. All Haitian International and even wonders where is the Third Power ?"
